The Issue
For years, our NGO has been supported by generous individuals and groups from around the world, enabling us to carry out noble work that has significantly benefited our community. However, the proposed FCRA (Foreign Contribution Regulation Act) Amendment 2026 currently under discussion in the Indian Parliament poses an existential threat to our operations. This amendment may unfairly penalize NGOs like ours for technical errors or changes in our funding needs.
Under this proposed amendment, NGOs that have historically received foreign funding, but are now financially independent or require reduced funding, could face severe consequences. One of the most concerning aspects is the possibility that the government might seize assets that were created using foreign contributions. This is unjust and undermines the trust and dedication that donors, volunteers, and beneficiaries have invested in our services; besides being a concern about natural justice.
According to the World Bank, foreign contributions play a crucial role in supporting development projects in India, with billions of dollars in aid helping to alleviate poverty, support education, and improve public health. Penalising NGOs for their success in achieving financial independence is counterproductive and detrimental to the social fabric of our nation.
We call upon the members of the Indian Parliament and the government of India to revise the proposed amendment with a view towards fairness and practicality. Concrete measures such as clear guidelines, a transparent regulatory framework, and an appeals process for NGOs could alleviate the risk of unjust penalties. A balanced amendment would ensure that NGOs continue to thrive and contribute positively to India's development without the fear of arbitrary action.
