Urge NYS DOT to Cover Route 9P Repair Costs

The Issue

Six years ago, the New York State Department of Transportation undertook repairs on Route 9P in Saratoga Springs, NY, permanently damaging the stairs that provide our community's only access to our waterfront deck—a cherished gathering place that has served our neighborhood for decades.

Since 2019, residents have been effectively barred from this vital community space where families once gathered, children played safely, and neighbors built lasting connections. What was once the heart of our community now sits inaccessible, a daily reminder of the state's failure to take responsibility for the damage they caused.

When we approached the NY DOT seeking a fair resolution, they offered to cover a mere 15% of repair costs—an insulting response that would leave our homeowners association shouldering tens of thousands of dollars for damage we absolutely did not cause. This forces working families and retirees in our community to pay out of pocket to fix what the state broke.

State infrastructure projects should strengthen communities, not destroy them while leaving residents to foot the bill. The NY DOT has both a legal and moral obligation to fully restore what their work damaged, especially when that damage cuts off access to spaces essential to community life and property values.

We demand the NY State Department of Transportation take full financial responsibility for restoring our waterfront access. Anything less fails every principle of fairness and accountability that should guide public agencies serving New York residents.
