Urge India's Government to Respect the Rights of Nepali Residents
The Issue
We are in contact with long-time Nepali resident/diaspora in India, we have experienced they are living peacefully and as an Indian. Many of them rose in the business and also in politics. However, recent incidents at Mumbai international airport by the immigration officials and Sahar police station, we have been told firsthand the weight of unjust accusations of dual citizenship.
They live in India under the binding mutual agreement known as the Indo-Nepal treaty, which grants them rights equivalent to any Indian citizen. However, recently, systematic and baseless allegations of dual citizenship have led to unwarranted harassment, especially in airports.
Nonetheless, irresponsible gratuitous allegations are fostering a climate of isolation and fear among the Nepalese community in India. They are facing unnecessary legal actions that has destabilize their ives and negatively impact decades of harmonious coexistence between India and Nepal.
Statistics from the Indian Ministry of External Affairs suggest that there are over 3 million Nepalese citizens living in India under the Indo-Nepal Treaty. Disrupting their lives with unfounded accusations is not just an affront to their rights, but it also underpins the vital human rights tenet of the United Nations, posing a global concern.
We, therefore, call on the Government of India, to show empathy, recognize their contribution and their rights as dictated by the Indo-Nepal treaty, and immediately stop these harmful practices. Arresting these people who have just an election ID card of India and Nepalese citizenship card does not confirms that they hold dual nationality and doesn't promote national security - instead, it creates fear and division amongst innocent people who have established their lives here based on the agreement between two sovereign nations.
