Urge HOA Board to Hold Meeting for Article 6.1.6 Amendment (Trash Cans)
The Issue
The current verbiage of article 6.1.6 in the “Declaration of Northgate Phase 5 Planned Community” restricts the placement of trash cans to inside the garage, with the exception being a window of time before and on trash days. Were it to be followed exactly as written, this would cause great inconvenience and significantly contribute to the lack of available parking in the neighborhood.
While the regulation was never enforced in prior years, the current administration has taken action to begin initiating violations against homeowners per the regulation. This has put almost every home in Phase 5 in a state of noncompliance.
There is no benefit to this, as placement of the trash cans in back alleys does not contribute to the neighborhood or property value in any negative manner. They are well out of the way and nowhere near the front of the homes. Placement of trash cans in the garages, however, can lead to undesirable and/or unsanitary conditions. It would also exacerbate the already challenging parking situation in Phase 5, as the garages are not capable of fitting even a standard size car and both large trash cans within them with any sort of ease. The board has consistently refused to bring this to a vote at a planned meeting despite multiple requests from the homeowners they should represent. Therefore, we are signing this petition in order to showcase that a majority of Phase 5 is aligned with holding a meeting to vote on changing the verbiage to the following:
“Trash cans provided by the current or future contracted haulers shall be kept away from the edge of the driveway until the evening prior to scheduled pick-up and shall be returned to the side of the driveway, placed in or placed in front of the garage no later than 24 hours after collection. All other refuse containers are to be kept inside the garage until the evening prior to scheduled pick-up and shall be returned to the garage no later than 24 hours after collection.”
By amending article 6.1.6 to allow more flexibility for trash can placement within our community's guidelines, we not only promote better sanitation practices but also give homeowners the autonomy they deserve when it comes to managing their properties. We feel that this is a fair compromise and that the HoA and board members should be upheld to the standard of representing the needs and concerns of homeowners in Phase 5.
