Urge Govt of Karnataka to Release New Apartment Ownership Act 2025
The Issue
The Karnataka Apartment Ownership Act plays a crucial role in governing the rights and responsibilities of apartment residents and owners across the state. With rapid urbanization and growing numbers of apartment complexes, Karnataka is in dire need of an updated legislative framework to streamline the management and ownership of residential apartments. The new Karnataka Apartment Ownership Act 2025 promises to address these concerns by introducing clear directions and guidelines that will benefit both current and prospective apartment dwellers.
Currently, many apartment complexes face issues such as ambiguous management practices, conflicts among residents, and challenges in the transfer of ownership rights. An updated act can provide a standardized approach to handling these issues, ensuring that the interests of all stakeholders are protected and fortified.
Neighboring states have successfully implemented similar updated acts, leading to more organized communities, enhanced cooperation among residents, and a reduction in legal conflicts. By following suit, Karnataka can ensure that its residents enjoy improved living conditions and the peace of mind knowing their rights are safeguarded.
The delay in implementing the necessary changes could exacerbate current issues, leading to increased dissatisfaction among apartment residents and potentially hampering the growth of the real estate sector.
Karnataka Home Buyers Forum, a home buyers representative group submitted the draft act to Govt for their review in December 2023 itself and its more 20 months, no orders from the Govt. The subject has been discussed in the Karnataka Legislative Assembly multiple times and Honorable DCM Sri DK Shivakumar themselves announced they are in the process of bringing new apartment ownership act in line with RERA. Honorable High Court of Karnataka also given directions to the Govt of Karnataka in January 2025 in WP 202 of 2025 to submit their response to the court on the new apartment ownership act. But still the Govt not released the new act!
We urge the Government of Karnataka to prioritize the release and implementation of the Karnataka Apartment Ownership Act 2025. Doing so at the earliest will provide much-needed direction and clarity to apartment residents and owners.
