Uphold the Right to Travel Freely in Gastonia, NC
The Issue
In Gastonia, North Carolina, a foundational human liberty is under silent attack — the right to travel freely without government interference. This right is not granted by the government; it is inherent, inalienable, and protected by the Constitution. Across our city, residents are experiencing rising incidents of unconstitutional checkpoints, unlawful stops, and arbitrary detainments under the guise of “public safety.”
These actions are in direct violation of fundamental legal protections:
The Fourth Amendment of the U.S. Constitution protects against unreasonable searches and seizures, requiring probable cause before any detention or investigation.
The Fifth and Fourteenth Amendments safeguard liberty and due process, which courts have interpreted to include the right to travel freely within the United States.
In Kent v. Dulles, 357 U.S. 116 (1958), the Supreme Court held:
“The right to travel is a part of the ‘liberty’ of which the citizen cannot be deprived without due process of law…”
In Shapiro v. Thompson, 394 U.S. 618 (1969), the Court emphasized:
“The constitutional right to travel from one State to another is firmly embedded in our jurisprudence.”
Despite these long-standing protections, Gastonia residents continue to face unlawful detentions, license checkpoints, and excessive identification demands — even when no crime has been committed. These actions convert a God-given right into a state-controlled privilege, and that is unacceptable.
We must also acknowledge a vital legal distinction: Article III courts, established under Article III of the United States Constitution, are the only true courts of law with judicial power to adjudicate matters of life, liberty, and property. These courts uphold due process, apply the Bill of Rights, and protect the natural rights of the people.
In contrast, administrative courts, corporate tribunals, and contract-based traffic courts often operate under color of law and lack the full authority of an Article III judicial proceeding. True justice must flow from a constitutional court of record — not a revenue-driven administrative process.
The people are not subjects. We are free inhabitants, entitled to unrestricted travel unless we violate the peace.
We recognize the importance of safety. But true security is never achieved through fear, force, or coercion. It is achieved through trust, transparency, and respect for the people’s rights.
We, the undersigned, demand the following immediate actions:
Cease and desist all unconstitutional traffic checkpoints and license stops without probable cause.
Require all law enforcement officers to be trained in constitutional law, civil rights, and the limits of corporate jurisdiction.
Mandate full transparency, including public access to dash/body camera footage and stop records.
Reaffirm that all alleged violations of law must be addressed in a court of competent jurisdiction — not a commercial administrative venue.
Establish community oversight boards with authority to investigate civil rights abuses.
Freedom of movement is not a luxury. It is not a privilege issued by the DMV. It is a constitutionally protected liberty — enforceable in an Article III court of law.
By signing this petition, you affirm that the natural rights of the people, including the right to travel, must be preserved and defended at all levels of government. Together, we call for restoration of due process, lawful jurisdiction, and the liberty our Constitution guarantees.
