Upgrade Animal Sexual Assault from a Misdemeanor to a Felony

The Issue

Like many of you reading this, I am an animal lover and a pet owner myself. It wrenches my heart to realize that the creatures we love so dearly are often subjected to unthinkable atrocity and cruelty. In today's society, it's unfathomable that the sexual assault of an animal is considered a mere misdemeanor and not a felony. Animals, like my dear dogs, cannot articulate their pain and confusion. They rely on us to ensure their protection and well-being.

Here in California, Penal Code 286.5 (a) states “Every person who has sexual contact with an animal is guilty of a misdemeanor."

Current Legal Status of Animal Sexual Abuse in the U.S.

As of 2024, bestiality is illegal in all but four U.S. states (Hawaii, New Mexico, West Virginia, and Wyoming).

However, in many states where it is illegal, it is only classified as a misdemeanor, meaning lighter penalties.

Only 15 states classify animal sexual abuse as a felony, ensuring harsher punishments.

Why It Should Be a Felony

1. Link to Human Crimes

Studies show a strong correlation between animal sexual abuse and child abuse, domestic violence, and serial offenses.

The FBI recognizes animal abuse as a gateway crime that can escalate to violence against humans.

2. Trauma and Suffering to Animals

Animals experience severe physical injuries, infections, and long-term psychological distress.

Many survivors of bestiality require euthanasia due to the trauma inflicted.

3. Lack of Adequate Punishment in Misdemeanor Cases

Misdemeanor penalties often result in small fines or short jail sentences, allowing repeat offenses.

Felony charges provide stronger deterrents and prevent offenders from working with or owning animals again.

Statistics:

A 2018 study found that over 30% of animal abusers had committed sexual offenses against animals.

70% of bestiality cases involve additional forms of animal cruelty, including torture or neglect.

In a review of sex offender registries, about 40% of those convicted of animal sexual abuse also had child pornography or assault charges.

The legal system should reflect our societal values; however, the current law does not align with them. This lax legislation exposes our vulnerable animals to persistent threats. Studies have shown clear links between animal abuse and domestic violence, with many animal abusers likely to commit violent acts against people, too (American Humane Association). A Michigan State University study also cites individuals who abuse animals are five times more likely to commit violent crime.

By upgrading animal sexual assault from a misdemeanor to a felony, we, as a society, are acknowledging the grave consequences of this crime. It's taking a stand against violence and promoting kindness towards all living beings. The charges should match the severity of the crime committed to ensure justice is served and prevent future crimes.
