Repeal Section 230

The Issue

This petition is aimed to have the Supreme Court repeal section 230 of the communications decency act. Twitter, Facebook, Google, and Apple have proven beyond any doubt through their recent actions to be acting as publishers and not the prescribed platforms eligible for government protections. This can be demonstrated through the flagrant violations according their own terms of service and the partisan enforcement of those guidelines. 

These publishers are the only publishers who reap the benefits of government protections from litigation under the constitution. The governmental protections that are guaranteed to these publishers who would participate in practices would suggest that the government not only condones their actions but  will actively defend these actions. 

Twitter, Facebook, Google, and Apple are private companies, and as such they can allow or ban people from their services as they see fit. However these companies are not entitled to governmental protections that prevent the litigation of civil right violations against them. Section 230 in effect, has made the government and the American people by extension impotent in the ability to litigate against these company when they cross that line from platform to publisher. 

Repeal section 230 and allow the court systems to determine when and if these Tech Giant violate the law.
