RE: The case of Noriko Kenjie Fuentes Cubian.
Dear Honorable Sirs and Madame;
Greetings! I am writing your good office in behalf of the parents of NORIKO KENJIE FUENTES CUBIAN, who is a Filipino, single, 26 years of age and a resident of Cebu City, Philippines.
Noriko travelled to the United States of America to pursue his American dream. Whom his parents helped him despite their financial adversities just to support him on his studies and future career thereafter. However, that dream is now jeopardized because of his dilemma with one single mistake – “Enticing Minors for Sexual Acts”. It’s a long process to build a character but only takes one split second to shutter. The cause was via online dating platform called GRINDR that tempted his highly susceptible young mind to try new adventures for curiosity’s sake. Unmindful of the laws in the State of Utah that was recently amended to immediately rescue minors who become prey to child molesters online. Hence, this same new law operated on him which they succeeded without the need for a warrant implicated Noriko heavily that he cannot fight alone in a foreign land away from his family.
Noriko was arrested and charged by the County Summit Park City police on June 25, 2019 at 02:59:12. We believe Noriko’s prior statements of admission infringed him badly, while he was surprised/shocked when the presence of the authorities showed up during the supposed meet-up. The Miranda Warning was declared to him only after he was pressured to admit what laws he violated and the charges. When he was arrested, NO ONE was ABLE to contact him, it was like his civil rights as a human were extinguished during that fateful dawn. No one from the Philippine Embassy were contacted about his arrest. While the procedure should have informed the Embassy of the Philippines, where he should have been held in custody while waiting for the formal charges to be filed in court. Noriko had no way of knowing what statute laws of the State of Utah as he is not a citizen and was only there for a temporary period of time.
I believe Noriko may be experiencing late stage of “Identity Crisis”, a process that normally occurs in adolescents between ages 12 to 18. He may face the consequence to what the law outlines as he already admitted his mistake and that was only done out of curiosity (due to his loneliness abroad). We respect and subject to the Laws but beg for the adherence to the Rule of Law without the repugnance of human rights. I’m sure the Honorable Courts of Utah would understand Noriko and this temptation that stirred him through this web application GRINDR. Hope they may consider reducing the penalty imposed on such degree of offense since he hasn't induced an actual minor on the premeditated course of rescuing a supposed child/minor from being hurt. At first, we thought it was an orchestration staged by the “watch dogs” - the Creep Catchers USA. But it wasn’t, their intention to pose a decoy was to keep a child from going through traumatic experience. Noriko took that bait while he was only curios and totally unaware to any of those serious and possible felony charges, that's why he did not resist the arrest, neither he denied he chatted with the supposed boy (the decoy).
The disposal initiated by “Creep Catcher” was a noble one, to safeguard its young from being harmed or molested. We understand their imposition on the provisions of their laws. However, the supposed law to shield the minors as prey from predators had an undue course on our fellow. This now made him realize, remorsefully and committed to change and reform his very self. We Filipinos are peace loving citizens, known as people with great yield and forgiving hearts. On the case of Noriko, he was alone in a foreign country and his loneliness made him gullible to the temptations laid before him. He has no record of any misbehavior or any criminality that would convince us his capability in committing such crime.
Hence, together with our relatives and friends express our prayer and supplication for the dispensation of Noriko Kenjie F. Cubian. May you reconsider his innocence as he never meant any harm, and may he be granted probation so he can be treated in a facility which he urgently needs rather than incarcerated in a cell that would suppress his young and agile mind as a human being. After which, may he be permitted to return home safe and be given a second chance to recuperate with the society he was accustomed with. We are optimistic that your Honorable Court and the State of Utah would reconsider our plea. We also hope and pray that the adjudicator could impose a lesser penalty on Noriko, since we do not have that financial capability and may yet to look for other resources just to raise the fines/bail amount required.
We appeal that the accused be allowed to be contacted even through a simple telephone call from his relatives in the Philippines, with a permissible window time of a certain day of a week. This we value so much as this is the first time Noriko lives outside his comfort zone far away from the family house he grew up with in the Philippines. On this regard we look forward that the community and fate would be kind enough to support on his successful reformation.
