I've dealt with a variety of California state and local agencies over the years and I've been appalled at the profound disrespect their management and key operating employees have for the dictates of the California Legislature which has the State Constitutional power to regulate those agencies activities anytime, but chose not too. Below are the laws under which San Luis Obispo County Residents has sued the State. The profound disrespect and arrogant civil law breaking manifests itself in California federal/ state agencies' management and key operating employees' refusal to comply with The Rule of Law in a timely matter, The Clean Water Act, The Environmental Review, National Environment Policy Act, California Public Records Act, The California Environmental Quality Act, Freedom of Information Act and Environmental Justice and Environmental Racist Discrimination for example to name a few. And for these elected officials that must follow the rule of law, in regards to the compliance with laws which bind all Federal/State agencies. Members of the public are treated as nuisances, nothing more, in the quest by those management employees and key operating employees to ingratiate themselves with key decision makers in the industries the California Federal/State agencies regulate. We can all speculate as to what those Federal/ State employees seek to gain for themselves personally but the problem is pervasive. I hate to say it but the level of moral and ethical corruption of the California Federal/ State agencies is equal to that found in the City of Chicago in the 1960's when the late Mayor Richard J. Daley was in control and allowing the dead to vote. Very soon California's Federal/ State agencies may reach the level of moral and political corruption found in the Central and South America. Hopefully the legal entities that are there to protect us, do not have their hands in other countries bank accounts at the sake of USA citizens. At least one good thing could happen (awareness of the issues at hand) seeing the rest of us getting poisoned daily from the pollution, spills, cracks and leaks from the oilfield and pending underground pipelines that I alleged the Board of Supervisors have approved or will approve. My parting comments are that everyone knows by now, this has nothing to do with political parties. It is all about money and who has enough of it for them to listen. The only way to unmask corruption is to campaign against lack of transparency and access to information, empower citizens, close loopholes and public sector reforms on disclosure budgets information, which will prevent waste and misappropriation of resources. This fundamental change will help society at large and help keep Big Oil out of the pockets of elected officials and legislation and safeguard our health and safety. People should not be devastated at losing their homes, their land, and their health just so that people can have a larger bank account. This situation is dire all over the County, we don't want it to take place in our small beautiful town too. The generosity that I took to fight this on my own without any prior education, resources or attorney has been one of the greatest pleasure of my life. And I hope one day that I can say that I made a difference in this small town that I call my second home. I continue to stand behind other environmental groups and activists to protect San Luis Obispo County environmental/ water laws and all citizens health and well being. Lets tell The California Energy Commission to reject underground pipelines in San Luis Obispo to Nipomo. Below are facts that I think are currently impacted this County and the public should be aware of. The pollution data from Homefacts website is that there is “very high” and “high” levels of pollution in the air in Monterey, San Luis Obispo and Santa Barbara Counties. And numerous superfund sites, brownfield sites and oil spills in San Luis Obispo County. 1. “Very high levels” of chemicals at San Ardo Oil Field @ Co2, Methane and N20 levels 2. ( 3 ) Superfund sites in Arroyo Grande (read homefacts for the locations) 3. (2) Polluters in Arroyo Grande/Santa Maria @ Phillips 66 Refinery and Plant 4. (25) Oil Spills in Arroyo Grande ( read homefacts for the locations) 5. (18) Oil Spills in Pismo Beach (read homefacts for the locations) 6. A “Brownfield site” in Pismo Beach @ Old High School/ Old City Hall, Police Department and Fire Department Note: there was an old gas station that had an underground spill. Usually these places are contaminated for up to 100 + years. Many people get cancers or other illnesses at these sites (don't drink/cook/shower) with the water at this location. 7. Camp Roberts at San Miguel is an Active Superfund Site. 8 “High levels” of chemicals in San Luis Obispo at Cold Canyon Landfill @ Co2, Methane and N20 levels 9. “High levels” of chemicals at Arroyo Grande Production Facility @ Co2 levels = 39,142, Methane levels = 18, and N20 levels = 27 Note: The levels were collected in January of 2012 and I'm sure it has gone up since then. 5 years down the road and it has not been updated. ( NO environmental review has taken place) I believe that is when the lawsuit started, it had high levels at that point. 10. A “Brownfield site” in San Luis Obispo at the Old Tank Farm Road Fields/Chevrons Property @ A century later and on a hot day, oil bubbling up can be still seen on the surface. 11. A “Brownfield site” in the whole town of Avila Beach @ Unocal/Chevron pipeline breaks 24,200 gallons of crude oil flows in the town. 12. A Oil Spills in Arroyo Grande @ Price Canyon Road Oil Field/Arroyo Grande Oil Field 13. A Oil Spill in Santa Maria @ Santa Maria Phillips 66 14. A Oil Spill in Guadalupe/Nipomo Dunes @ Guadalupe Oil Field/ Ocean Contact 15. A Oil Spill in Santa Barbara County @ Refugio State Beach/ Ocean Contact 16. Check out "EWG" for short (environmental working group) for the quality of your tap water, just put in your zip code and it will go directly to the tap water database in your city or state. Footnote: We, the people demand full disclosure of the specific details of the plan to build a underground pipeline from Price Canyon Road, underneath highway 101 to the exact route including names of roads, streets, avenues, lanes and courts, all of the business names and addresses, and all of the homes addresses to the resting place of the Nipomo Park and beyond? Are you aware of any businesses or property owners that currently or will in the near future have a Condemnation/ Eminent Domain process on their property? If so, who are they or how many people are their? Are you also aware if any people volunteered to sell their property to the oilfield/ gas owners? If so, who are they or how many people are their? What is the exact dollar amount of money, the San Luis Obispo County is going to charge the oilfield/gas owners to lease the Nipomo park to them? A breakdown of where the 1.2 million dollars will go that has been approved? Will this money go towards helping financing the oil/gas pipeline project in any shape or form? Or relocation to a new park for the Nipomo citizens? Is the new “waterline” to the Dana Adobe Visitors Center “NEAR” the park? And “NEAR” the new underground oil/gas pipelines project? How will the closed down contaminated wells at the Dana Adobe Visitors Center be addressed? And what are the chemicals that contaminated those wells? Is this property listed as a superfund site or brownfield site? And include the dates of discovery of the contamination? Is the public aware that the Dana Adobe Visitors Center has contaminated water wells and land? How has this cleanup/ disinfecting of the soil, water, land occurred and for how long and by whom? Include in your full disclosure to the community, regarding the funds the specific, measurable, attainable, relevant, time – bound outcomes and cost that you predict about the underground pipeline project? In addition, include the royalties amount that San Luis Obispo County will obtain from renting the property to the oilfield/gas owners? What does the County plan to do with these thousands of dollars per month and millions of dollars per year, they will receive from this sweet contract with the oilfield / gas owners at Arroyo Grande Oilfield and Phillips 66 Company? Is the Nipomo city water cleaned by ammonia and fluoride only? Or are you cleaning the water with chlorine alone? Did the US/EPA tell you to clean the water to reduce the precursor organics? I have meet several folks that had 2 or more people in one household that developed cancer in Nipomo and in-addition it has been reported on the news as well (which is rare cancer statistic) is it from your water and lack of following water regulations?
