Wake County Public Schools Denied Special Education Recipients the Equal Right to Choose

The Wake County Public School System has recently confirmed its decision to offer both an In-Person option or a Virtual Academy Option for the 2021-2022 School year to all students except students in the Special Education Class setting, to whom it is denying that option to chose Virtual Academy.

Wake County has attempted to justify this decision by stating it limited the options to both students in Special Education Settings and Students in Regular Education Settings. What is true is that Wake County did not offer Virtual Academy as in option at a handful of application based schools, meaning the students still have the option to select Virtual Academy by switching schools. An option which students in Special Education classes remain excluded from across the board.

Title II of the ADA applies to State and local government entities, and, in subtitle A, protects qualified individuals with disabilities from discrimination on the basis of disability in services, programs, and activities provided by State and local government entities. Title II extends the prohibition on discrimination established by section 504 of the Rehabilitation Act of 1973, as amended, 29 U.S.C. 794, to all activities of State and local governments regardless of whether these entities receive Federal financial assistance.

This applies directly to public schools. Wake County is located in Raleigh, North Carolina and was the 14th largest school system in the Nation as of 2016. It is also notoriously one of the most difficult to go up against in the battle for equality for Autistic, ND, and Disabled Students unless you can afford to buy justice in years of litigation. Thus far parents have been very unsuccessful in our attempts to dispute this glaring discrimination with the Superintendent of Special Education Services. We need your help.

We are asking that all champions of Human Rights and Social Justice come together to amplify a united voice demanding Equality of one of the most oppressed communities across the Globe. 

* I would also like to apologize in advance for use of the term "Special Education". This was not at all a term I included in my vocabulary before needing to gain widespread attention on this issue and for the 'greater good of making sure a broader audience understood what was happening I opted to use this outdated undermining terminology. In standard conversation if necessary I would reference this type of learning as Accessible Education. I hope it is understood why I had to make the difficult decision here to not do that.
