Equal Pay For People With Disabilities

The Issue

Under Section 14(c) of the Fair Labor Standards Act employers are able to pay the employees with disabilities under the minimum wage of $7.25. This outdated law was passed in 1938 and makes the assumption that people with disabilities are less capable of doing their job than their coworkers. 

There is currently legislation going through congress that reverses this ableist law. The Transformation to Competitive Integrated Employment Act (H.R. 2373) provides people with disabilities, many of whom work in settings that fail to prepare them for integrated employment in the mainstream economy, equality in the workplace.


Supporters of this law make the argument that this is because they do less productive work than their coworkers. In some cases this may be true, however this law allows for anyone, no matter their skill level at the job,  who has a disability to get paid less than the minimum wage. It doesn't matter if a person is deaf and working with their hands or in a wheelchair working at a desk, they could still be paid less than the minimum wage.


To conclude, we are asking Victoria Spartz and the other members of the United States House of Representatives to sign Transformation to Competitive Integrated Employment Act (H.R. 2373) that repeals Section 14(c) of the Fair Labor Standards Act and allow everyone the right to be paid the minimum wage.
