Unfit to Stand Trial, But Fit to Appeal? Protect Victims Now.
The Issue
Firstly, I want to say thank you
To everyone who has reached out, your support and shared experiences have meant more than I can put into words.
What has become so clear is this: my story is not unique.
So many victim/survivors across Northern Ireland and the UK feel let down by a justice system that is meant to protect us, but too often feels like it favours the defendant.
I am one voice, but I know now I am one of many, and I want to use my voice to stand for all of us.
A survivor is calling for urgent reform after a defendant deemed unfit to stand trial was still able to appeal. With a hearing set for 23rd June 2026, this petition demands fairness, transparency, and stronger rights for victims.
We are calling for change. We ask the UK Government and the Department of Justice Northern Ireland to:
- Review appeal rights in finding of fact cases
- Introduce transparency around who can instruct appeals for individuals without capacity
- Ensure safeguards are in place when legal representatives act on behalf of unfit defendants
- Strengthen victims’ rights to be informed, supported, and heard during appeal proceedings
- Prevent unnecessary traumatisation of victims through repeated legal processes
