Deny DPNR Application No. ZAT-15-4

The Issue

Re: DPNR Application ZAT 15 4 Lionel Warrell Remainder of 30C Estate Elizabeth, St. Thomas

We oppose Mr. Lionel Warrell’s request for a zoning change for the following reasons:

1. Families have bought land and built their homes in Mafolie because it is a RESIDENTIAL neighborhood. A rezoning of the nature Mr. Warrell requests will give access to any and every type of commercial activity. 

2. The proposed building plan is grossly out of proportion and inconsistent to the property in question.  A business development of this nature will be devastating for the neighborhood and all the taxpayers who live there. REFER TO THE ATTACHED IMAGE

 Within a one mile radius of the property in question, there are already THREE look-outs for tourists – Mafolie Hotel, Drake’s Seat and  the tax payer funded scenic outlook on Valdemar Hill Drive (Skyline Drive) which offers the same view as Warrell’s property. And a short ride from there are Sibs Bar and Restaurant and  Mountain Top with cold drinks,  ample  parking, and facilities to deal with a large number of tourist and the safaris and taxis that bring them up there.

3. If Mr. Warrell’s project is approved it  will congest the neighborhoods small roads even further.

4. The road is already heavily congested, often with cars parked on BOTH sides of the road making it nearly impossible for the safe passage of two way traffic.

5. An earth change permit was not posted on the property. Doesn't the law says that 30 feet on each side of a gut must remain untouched? This land was scraped clean of all vegetation right down to inches of the gut.

6. In the process of clearing the land, rocks and other debris rolled onto the roof of neighboring property and into the gut itself causing damage to both. Mr. Warrell has demonstrated indifference to the concerns and safety of the neighbors.

7. According to DPNR, Mr. Warrell also had no permit for the truck loads of fill he had dumped on the property, (on a Government holiday); nor did he have a permit for the container he installed on top of the loose fill; nor did he have a business license to sell from DLCA.

8. After Mr. Warrell altered the terrain by illegally bulldozing the land, homes in the area have been flooded with mud and water, and the public road (which is the entrance and exit from his house) was seriously and dangerously undermined in the recent heavy rains. These are problems that did not exist before his action.

9. Mr. Warrell bought this property knowing that it is zoned residential.  If he wanted to go into business, there are any number of commercially zoned properties that he could have purchased.   With this piece meal rezoning, are there to remain any true residential areas where one can enjoy some peace? Please protect the remaining residential areas of this neighborhood as this commercial venture will greatly reduce the quality of life and cause further issues for the residents of this area.

10. There is no need for this business in this area with all the other concerns listed above. 

This land is zoned residential and must stay that way!
