Please review Andre Scott's case and look at all the evidence which was overlooked. An innocent man was given a 116 year sentence. Does this seem right to you?

The Issue

 I am writing you this letter out of desperation and I am the voice for his three sons’ that have not been able to be raised by their father and I am the voice of his family. My husband Andre Scott was wrongly convicted of a crime he did not commit. Andre fell under the 3rd Strike Law which is terribly flawed and was given 116 years in prison. The crime he was wrongfully accused of was armed robbery.  No one was murdered, no crimes committed against children or women and no one was harmed in any way. His previous strikes were issued back in 1989 when he was a 17 year old kid. Until this situation, Andre like many young men in our society did not understand or know the meaning of freedom until it is taken away. When you are a child, you think you are invincible and consequences for your actions mean nothing.  You do not know the meaning until it has been taken away from you by a flawed system.  It has really hit home for all of us because he is innocent. Andre Scott did not commit this crime and is serving a 116 year sentence based on the 3rd Strike Law.  At the time this crime took place Andre was married, had a family, had a full time job and was a contributing part of our society.

 

Andre’s conviction has taken a toll on his entire family in many ways. When he was sentenced he had a pregnant wife and two young sons, he has nieces and nephews he has never seen or met, he had a stable job and was making enough money to support his entire family. His mother is a 23+ year employee of the District Attorney’s Office in Sacramento and she has not been able to speak up nor has Andre really pursued his case.  They were both in fear of retaliation that his mother could possibly face and now that she is close to retirement we as a family are moving forward to draw attention to his case. For the last 13+ years she has gone to work and had to see, interact, remain professional and be in contact with some of the same individuals that gave her son 116 years. Through all of this she has managed to keep her composure day after day and continue with her career.  Since Andre was sentenced, he missed the birth of his youngest son, missed his father’s passing and funeral and missed his grandfather’s passing and funeral. He has missed his boys growing up and so many other milestones that he can never get back and that we take for granted.

 

There are several facets to this wrongful conviction that I would like for you to review. I have evidence of the following:

·   Falsifying / forgery of a Judge’s signature. This was proven by a hand-writing expert that submitted his findings to the court. This individual also worked on the Zodiac Killer case and  Blanco & Associates Inc. (Forensic Document Examiners)

·   The Sacramento Police Department entered Mr. Scott’s residence with a search warrant that was not signed by a Judge. He was not on probation or parole when they entered, therefore it was not justified.

·   The time was changed on the warrant to justify the unlawful entry.

·   His family has paid over $20K in his legal defense which did not call his witness to testify.

 

·    We are in possession of the following documents:

Exhibit E- Superior Court Order and My Response to that Order

If the facts of the case were true and correct and all was on the up and up, there would be no need for the forgery, falsifying and altering documents and the unlawful entry of his residence. We hear about wrongful convictions quit often. When will our court / judicial system take ownership and accountability for mistakes that have been made during these wrongful convictions? The courts continue to throw lives away because they have the power to do so. This is a very unfortunate situation and I am reaching out to any and everybody  for any type of support and assistance you can offer Andre Scott and our family. He is now being represented by an attorney who I recently hired. Like all processes when dealing with the State/County/Federal, you are on their time. I think 13+ years in prison is long enough, don’t you?
