My Husband and I have been married for 3.5 years and have went through legal means of immigration. I have visited him 8 times over the last 5 years we have been together. Spent over 20k for his Visa. We have submitted every document asked of us. Been approved at the U.S based organizations (a.k.a USCIS, NVC) only to be denied twice at the U.S. Consulate in Mumbai. 1st time they said our documents were fraud(they were real) and that we didnt have enough support from our families. Everything was proven real at USCIS. The 2nd time was because my husband is diabetic. They said he could become a public charge because of a pre-existing illness. But, I make over 60k a year and had medical (and life) insurance already for him through my employer. And, this rule has been denied by the courts as of yesterday because it is unconstitutional. But, since we have already been returned to USCIS we are again stuck waiting the months and months it takes for re-approval. Please help me by signing this petition to bring my husband to the States. Help me show the consulate that the illegal means of denial won't be taken lightly. We have support for our relationship. And, the American people want to see legal immigration succeed. A struggle for Love and Immigration
Imagine taking your Daughter to the hospital, thinking she has the flu, only to be told she is Type 1 diabetic and insulin dependent for life. Imagine being a mother who knows nothing about diabetes. And imagine searching every area of the internet desperately trying to learn everything you can to help your child. Now, I know what your thinking. What does this have to do with immigration? Well, during my frantic searches for any information I could find. I had a reply on a Facebook page from a Man named Vinod (who is from India) who happens to also be diabetic.
On January 16th, 2015 my life would change forever. I found the most amazing supportive loving person I had ever met in my my life. We discussed the issues and struggles of diabetes. He told me he was attending college and that gave me hope that my daughter could still succeed in life after her diagnosis. We shared photos from His country and Mine. Talked about cultures, traditions and marriages in the 2 country. And initially came to the conclusion that a relationship would never work due to culture. But, after several months, it was undeniable that He and I had the most pure relationship anyone could imagine. We had to meet to see if a personal meeting would be as amazing as our Facebook relationship.
In August of 2015 I took the plunge and took off forr India. We only planned an 8 day meeting in Mumbai. I landed at the airport and the most shy, quiet man met me there and it was pure magic. The next 8 days flew by in a blink of an eye and sadly I was again headed home. After the meeting we were convinced more than ever that we could make this work somehow. But how? With his culture and risk to literally His life is his family disapproved then how could we do it?
After much discussion we decided that after only 8 days of meeting, maybe we should meet 1 more time before we did anything too crazy. In December of the same year I once again headed to India. We spent 3 weeks traveling between Delhi, Jaipur, and Agra. Visiting the Taj Mahal, Red Fort, Rajasthan desert. I was amazed by the culture and tradition in India. The people treated me like a movie star, and Vinod was a total gentleman. I knew this man had changed my life forever. No one could compare to Him and no one would tell us we couldn’t be together. There had to be a way to convince his family that this was best for both of us.
Once again I was back in the USA and continued our talks online. We decided that we just had to marry and be together forever. We researched online about how we could do this and learned that with the help of an agent in India we could do a court marriage without permission of his family and register it in Delhi. This gave us the ability to marry before telling too many in His family. In May of 2016 my daughter and I (yes she went because I wanted her approval also). We spent a month in Delhi learning to be a family and got married during our stay there. After a month in Delhi we flew to Goa to spend another 2 months in the rainforest of the Western Ghats in India for our Honeymoon.
After the 3 months quickly passed, My daughter and I returned to the USA and I applied for my
Husbands Visa to America. I was so excited when our NOA 1 was approved. More excited when the NOA 2 was complete. Then NVC approved us. But the wait for his interview was still several months away so I again snuck away to India to spend a few weeks with him once again.
Finally, the time had come in October of 2017 for his interview. I flew to India for the 5th time and actually booked his flight to return with me in a few weeks. We were confident that he would be so easily approved. We attended his interview. And the nightmare began. Six hours of interrogation. They accused Vinod of false documents. Accused me of marrying only for marriage. And even said that since the owners of my current employment were Indian, that somehow they had paid me to marry Vinod. All of which was ludicrous. Ultimately they gave us a 221g listing all the documents they wanted us to provide. We went to our apartment to sort out what had just happened. In the days to come we collected every single document which was requested. We even got 13 letters from his family and mine supporting our relationship. We printed a 1000 photos. Pages of chat logs and submitted it all to the embassy.
I returned alone to the USA heartbroken and confused. We waited for nearly 2 months before we got any response from the embassy. But, again they only wanted more evidence. So we submitted more files to them. Again several months passed before we saw a change online that said we failed to overcome the refusal and we were having our case returned to USCIS.
We were discouraged for sure but we continued to stay positive as the next year slowly creeped by. I made a couple of more extended trips to India. Finally, after over a year and a half since the first interview a simple letter from USCIS appeared in the mail box which simply read something like this “we have again approved your request for immigration Visa #..... and we will forward the case back to the appropriate embassy along with a request to approve your visa". No documents were asked. Only a simple approval. We were so excited. Surely this meant that his Visa was imminent.
We waited 4 more months for his second interview. In june of 2019 the day finally came. With over 6 inches of files in hand. Proof of 8 trips to India, complete chat logs from 4 years, and photos to boot. We were ready. Vinod was finally coming to America.
He entered the room and was told to go to window 18 where a Consular officer asked him only a few questions and sent him to finish up at another window. At the 2nd window He encountered a Consular officer who was laughing and talking to other people in the room. He even left a couple of times to eat a sandwich. He asked Vinod a couple of questions. Then said he couldn’t understand Vinods English. Which is crazy. He speaks very good English. Maybe not perfect. But being his 7th language that is to be expected. Anyway, the CO told him he would contact him and sent him home with no answers. Then at the hotel he was phoned to again go to the consulate. An officer who spoke Hindi and English questioned him for around an hour and gave us a 221g for my bank statements and sent him away. We provided the bank statement the very next day.
After 2 weeks His passport was again returned to us with a letter saying our case was AGAIN being sent to USCIS for possible revocation. I couldn’t believe it. The CO actually said due to him being diabetic he could become a burden to the state. Even though I already had medical, life insurance for him through my job. I feel like the embassy is just using any excuse to not give the visa due to the fact they denied it before and uscis again approved us. It’s simply a tug of war for power between the 2 agencies and we are the ones being punished for it.
After the denial I again went to India to be with my Husband. I finalized all my documents needed in India for my citizenship and work documents. I even got my Indian drivers license. Everything I need to make the move to India to be with him. I have that option. It won’t be easy, but we are out of options at this point. Due to the extreme length of our file I cant even get an immigration attorney. Or, if they are willing to take the case the cost is in the range of 8k+ which I simply can’t afford after 4 years of immigration fees, and 8 trips to India. Vinod and I added up the cost to this point and its somewhere in the range of 25-30k. I will never give up on my Husband. I will never leave Him. But without help from someone as to the what I can do next. I feel like my government has won. The embassy is untouchable and they are forcing me to move over seas and give up the fight. I pray someone will help us get our story told. So my Husband and I can be together. And, the consulate can be seen by the world, as the uncaring, wrongfully denying embassy that they are.
I have every document ever given to immigration and the embassy. I am an open book and I will provide all proof needed to check my history and my husbands. We are genuine, honest, people who have never been in trouble ever. And never provided any fraudulent papers to anyone. Never.
