The Issue

Petition Against HOA Restrictions on Playground Equipment, Basketball Hoops, and Common Area Access

We, the undersigned residents and property owners within the Two Rivers community, hereby petition against the restrictive policies imposed by the Homeowners Association (HOA) that prohibit the installation of playground equipment and basketball hoops on residential lots per Article VI, section 6.08 of the Third Amended and Restated Declaration of Covenants. Additionally, we oppose the limited access to common area facilities, such as the community basketball court, due to age restrictions imposed by the HOA.
We believe that children should have access to safe and enjoyable recreational facilities within their own neighborhoods. By restricting the installation of playground equipment and basketball hoops, the HOA is depriving children of opportunities for physical activity and social interaction, which are essential for their development and well-being.

Furthermore, the imposition of age restrictions on common area facilities such as the community basketball court is discriminatory and unjust. All residents, regardless of age, should have equal access to these amenities, fostering a sense of community and inclusivity within our neighborhood.

These restrictive policies not only impede the well-being and development of our children but also limit homeowners' rights to use and enjoy their properties as they see fit, diminishing the value of our investments and infringing upon our autonomy as property owners.

We urge the HOA board to reconsider and amend these outdated regulations to align with the needs and desires of the community. We propose implementing reasonable guidelines for the installation and maintenance of playground equipment and basketball hoops, as well as ensuring equitable access to common area facilities for residents of all ages.

By signing this petition, we express our collective dissatisfaction with the current restrictions and our desire for positive change that promotes a vibrant and inclusive community environment for all residents, both young and old.
