Change Wisconsin Current Law Regarding Fathers and Rights

The Issue

Back Story: On 2/8/2020 The Mother was Instructed to call 911 or seek Emergency care if my son any seizure like activity.

On 04/13/2020 @0245 in the morning my son had a seizure and the mother failed to act and neglected to call 911 and or take him to the ER. The mother texted me and said he had a episode She didn't even attempt to call me otherwise i would have told her to call 911. but no she went back to sleep. He is only 3 months old and was diagnosed with Ventriculomegaly while in the womb. So I called the the pediatrician after talking to the mom at 0930 when I woke up and saw her text.  and told them what the mom told me and they told me to bring my son in to be checked out. Long story short they diagnosed him with a having a seizure based off of what was said. so based off that decision on Tuesday @1600 hrs I picked up my son for our agreed time to spend time with my son (NO COURT ORDER).

I then made a decision based off what happend a couple days earlier because it was my understanding as the father on the birth certificate I have rights I refused to give my son back for his safety. The mother called the police the police called me and i spoke with the deputy and based off of my understanding and also the knowledge of the deputy the deputy said sir have a good night and i will let mom know that your son will be staying with you.

Well this morning 04/15/2020 at approximately 0930 a  Different deputy pulled into my drive way and spoke with me we sat here for almost 2 1/2 hours talking with my Attorney and the Attorney Council and based off of what they found  a VPA/ Birth Certificate dont give a unmarried man rights so i had no other choice but to give my son back to his mother. 

Currently under Wisconsin state law it states unmarried fathers do not have rights to placement or Custody even if a VPA (Voluntary Paternity Acknowledgement) is signed and you are on the birth certificate.

  • The Wisconsin Voluntary Paternity Acknowledgment form allows parents to establish paternity without having to go to court. A signed and notarized Wisconsin Voluntary Paternity Acknowledgment form filed with the Office of Vital Records fully establishes legal paternity. The father's name is then added to the birth certificate.

  • Filing the VPA form does not give a father legal custody or physical placement. Under Wisconsin law, an unmarried mother has sole legal custody until a court orders otherwise. 

                                                                           

 The reason I want to see this law changed is because it is not fair for a man that wants to protect his kid from harm or Neglect and be told you don't have rights unless you go to court. It is totally OK to sign a VPA with out going to court and  All because he don't have a court order giving him legal rights is Not Justice for Any Child.
