Tint Laws In Pennsylvania (Police Tax)
The Issue
In Pennsylvania tint laws are in a grey area. Most Officers will tell you as long as you can see through the vehicle the tint is not a problem. I completely understand that tint can make a police officer's job unsafe if the tint is too dark. But what about when officers and department of corrections officers are told it's acceptable to put tint on their car for protection. Pennsylvania Title 75 states nothing on the car that's non-transparent which means not being able to see through. Penn Dot has an outdated regulation stating 70% of the light should be able to get in the vehicle but that's a regulation, not an actual law. This gives officers the right to ticket at their discretion, but when does ticketing turn into harassment. Police will ticket Title 75 which does not state anything other then you must be able to see through the car. Police are having a field day taking good people with no traffic or criminal record just to make money for their township and I know this for a fact from working for the prisons and seeing good people imprisoned for the littlest things. A man in Harrisburg was given a $108 dollar ticket for tint on his car he took it to the state level and his ticket was overturned due to how much tint is a grey area in Pennsylvania. Why is it okay for every little township to have different rules on tint in the state of Pennsylvania? Why where I live can it be okay for me to have tint as long as its transparent but I can take a ride down the street to another township and be ticketed.
I am a retired correctional officer due to injury. The tint has been on my vehicle for 6 years for my safety, families safety and on top of it, I have sensitive eyes. I have never been ticketed for my tint and never had a problem with an officer with my tint. If I was ever pulled over I put down all my windows for their safety and my hands on the wheel.
In the last two weeks, I have been slammed with tickets about my tint, which would have been fine because I had no problem bringing it to court and fighting it. But instead I was harrassed being told I was a disgrace to law enforcement when asked where I was going I explained I was on my way to college and when he heard that he made me sit there for an hour and made me miss my first class on purpose. I was held up with no traffic or criminal record. Two weeks later the same thing happened I was stopped by the same officer he asked me for registration and insurance and I told him I had to look for it for a minute he said ¨nah you don´t have it¨ and hit me with a tint ticket, insurance and a registration ticket (which I did accidently forget to renew my registration.) This would have been fine but I pleaded not guilty and was not proven guilty yet. On top of it he laughed and said this is going to take about an hour to make me late for class again I called the sheriff's department and asked them to send someone out because I did not feel comfortable with the stop. They said they could not send anyone out but they would stay on the phone with a recorded line.
I have no traffic or criminal record 1/8 people in Pennsylvania have tint on their car including many off-duty police, ems and volunteer firefighters on their personal cars. If there is a law about tint what puts them above it? I am a retired corrections officer what is the problem with my tint for my protection. There is plenty of people with dangerous jobs why can't they protect themselves? Pennsylvania is one big loophole about tint. it's a way to tax the people
Please stand up for our rights. Section 75 states nothing nontransparent it also states you must be able to see through the car. 5% is different from 35% tint but if you are stopped by the police you automatically are treated like a criminal. A PennDOT code is not a law. I am requesting that either section 75 gets revised or Police stop giving upstanding citizens expensive tint tickets just to tax people.
