To Invesitgate and remove Chief of Police Jim MacSween by the Police Service Board

The Issue

We, the undersigned, recognizing our duty to uphold public safety and the rule of law in Ontario, make the following declaration:

Whereas the Community Safety and Policing Act, 2019 (CSPA) took effect on April 1, 2024, replacing the former Police Services Act and establishing the current legal framework governing the powers and accountability of Ontario police services;

Whereas under the CSPA, serious misconduct or unsatisfactory performance by a Chief of Police—such as issuing public statements that may undermine deterrence or public confidence—can trigger an investigation by the Police Service Board. The board may then initiate disciplinary measures, including demotion or termination, by applying to the Commission Chair to appoint an adjudicator to hold a hearing. 

Whereas the Act also empowers the Inspector General of Policing to intervene in cases of misconduct, including suspending or removing a Chief of Police and appointing a replacement or administrator if needed. 

Therefore, be it resolved and declared:

  1. That the York Regional Police Chief Jim MacSween's recent public advice encouraging compliance with thieves—which effectively signals an absence of resistance and may diminish public confidence in safety—constitutes conduct that ought to be examined for potential unsatisfactory performance or misconduct.
  2.  That the York Regional Police Services Board must, in accordance with its statutory responsibility under the CSPA, initiate an investigation into the Chief’s conduct.
  3.  That should the investigation substantiate serious grounds, the Board is obliged to proceed by applying to the Commission Chair to convene an adjudication hearing, where demotion or termination may be ordered as warranted.
  4.  That concurrently, we call upon the Ontario Inspector General of Policing to evaluate whether immediate intervention is necessary, which may include suspension or removal of the Chief and appointment of an interim administrator.

    We call on the Premier Doug Ford to reign in Justice for Ontarians, as this poor implementation of each persons Rights, is a complete failure of the Section 7 Charter Rights and Freedoms to 'security of the person'. We will not surrender our families. 

    This Declaration is made in the spirit of preserving public trust, the integrity of policing, and the fundamental security of the person, which is foundational to our rights under the Charter.
