Petition to Address Breach of Fiduciary Duty by The Vines Homeowners Association Board of Directors

We, the undersigned homeowners of The Vines community, hereby submit this petition to address our collective concerns regarding the current Board of Directors of The Vines Homeowners Association. We believe that the Board is in breach of its fiduciary duty to protect and uphold the home values and community standards that we, as homeowners, rely on.

Statement of Concerns

Failure to Enforce Community Standards:

• The Board has failed to enforce the established community standards and covenants, leading to inconsistency in the appearance of individual properties.
• This failure to uphold community guidelines is contributing to a decline in the desirability and market value of homes within The Vines.

Lack of Transparency and Communication:

• The Board has not been transparent in its decision-making processes or in communicating important information to homeowners.
• There have been insufficient opportunities for homeowners to provide input or receive updates on actions taken by the Board.

Our Demands

To address these issues and ensure that our community is properly managed and maintained, we demand the following actions be taken immediately:

• Call an immediate Homeowners meeting to discuss the current Chesmar exterior elevations and their impact on the home values of the community. 
• Notify Chesmar Homes of this petition to change the current exterior elevation standards. This information may be necessary to disclose to future buyers of these homes in the event Homeowner Association requirements are amended, which could cause future financial burden on those home buyers.
