Child marriage and marriage loopholes remain a serious human rights issue in the United States, enabled by inconsistent laws that vary dramatically from state to state. While some states have strengthened protections for minors, others continue to allow legal loopholes that permit children to be married under exceptions involving parental consent, judicial approval, or other circumstances. This patchwork system leaves countless children vulnerable depending solely on where they live.

The consequences of child marriage are devastating. Survivors and advocacy organizations have repeatedly documented patterns of coercion, exploitation, abuse, educational disruption, financial dependence, and long-term psychological harm tied to these marriages. Many victims face significant barriers to escaping abusive situations, particularly when they are legally minors and lack access to independent housing, legal representation, financial resources, or protective services.

According to  Unchained At Last, nearly 300,000 minors were legally married in the United States between 2000 and 2018. These figures reflect only officially recorded marriages and likely underestimate the full scope of the issue, as informal arrangements and unreported cases often go undocumented.

Children’s rights and protections should not depend on arbitrary state lines. A child in one state should not have fewer protections from exploitation or coercion than a child in another. The current inconsistency in laws creates confusion, weakens accountability, and allows harmful practices to persist.

Federal action is urgently needed to establish clear and uniform protections nationwide. This includes implementing a federal minimum marriage age of 18 without exceptions, strengthening enforcement mechanisms, and increasing funding for prevention efforts, survivor support services, education, housing assistance, and legal advocacy.

Protecting children from exploitation and forced marriage must be treated as a national issue, not a fragmented state-by-state debate. Every child deserves the same fundamental rights, safety, and freedom regardless of where they live.
