In an interview with VOA Somali on 28 September 2014, Somali Attorney-General clearly states that our territorial sea is 200 nm on the first question he is asked. The Attorney-General states 2009 MoU with Kenya is illegal and explains in detail why it is so. Unfortunately, he is quite on the current case submitted by the Somali president to the International Court of Justice in The Hague against Kenya which bares the same grave mistakes that makes the 2009 MoU with Kenya illegal as our Attorney-General correctly stated. We wish to clarify to the Somali people that there are two frontal attacks by the hyenas of the sea against Somali territorial Sea. The first one is waged at the United Nations which is aimed to officially record for Somalia a 12 nm territorial sea and 200 nm EEZ contrary to Law No. 37 of 1972 stating Somali territorial sea as 200 nm (inclusive of EEZ and continental Shelf) and all decisions of the Somali parliaments and cabinets. Since 20 December 1973, the only territorial sea law officially recorded at the UN for Somalia is Law 37. Somali president without due process submitted to the UN on 30 June 2014 a presidential proclamation recording illegally for Somalia a 12 nm territorial sea and 200 nm EEZ. It begs to ask the question how do the Attorney-General view the illegal acts of the Somali president? The second frontal attack is through the case submitted by Somali president to the International Court of Justice in The Hague against Kenya. As in the 2009 MoU with Kenya, the Somali document submitted to the court puts into dispute our sovereign territorial sea by stating Somali and Kenyan maritime zones overlap and two states are unable to mutually resolve them so the court should rule on it. This is what Kenya was all along looking for, 2009 MoU by the back-door. If the Somali president was defending our territorial sea he should have not put into dispute our sea and should have claimed them as sovereign Somali territorial sea which Kenya is infringing upon. The court process is a way to legitimize Kenya’s robbery of sovereign Somali territorial sea which is supported by powerful countries and interests. Wixii la qariyo, qurun ayaa ku jirah! The claim by Somali government of defending our territorial sea is surrounded by secrecy and contrary to the norms of state governance is centred on unknown advisory unit of the president. Somali territorial sea is bigger than the president; it is a national issue of paramount importance. Interestingly, the Attorney-General is asked by a caller to name the experts and lawyers of the Somali side, he did not name them but rather said will explain and provide to whoever contacts them privately. If they work for the Somali people why are they hidden from them? This petition has long been saying this secretive and unknown presidential advisory unit is financed and driven by Norway. We demand the Somali government to answer the following legitimate questions; what government body and process was reached at the decisions to submit the presidential proclamation and the case against Kenya, who are the experts and lawyers of Somali government, who is paying them and what is the role of Norway? Similarly, the president on 27 September 2014 was asked by VOA Somali if he and president of Kenya met at the UN General Assembly in New York on the issue of maritime dispute as it was previously said to happen, the president as usual did not answer. Why is the Somali president evading this simple question? The only way the Somali government can gain the trust and support of the people is to end the secrecy surrounding this issue of national importance and respect Somali constitution, laws and due process of state governance.
