The Issue

In recent days there has been many activists in Wisconsin to help save beagle puppy’s from a devastating situation at ridgeland farms which includes using these puppy’s as test subjects and most succumbing to the extreme amount of torture brought apon them. The police in Wisconsin have been using excessive force to take these activists down including shooting rubber bullet, tear gassing and spraying pepper spray in the eyes of these poor people, these activists are peaceful , they do not have intentions to harm anybody so in conclusion to this matter I am raising a petition not for just this situation but for there to be a law allowing rescue missions to happen under the pretense that a facility is illegally abusing animals. This is not only for those poor beagles but for every animal trapped in a facility like this all around the world.

A BILL

To amend the Animal Welfare Act to establish a pilot program for expedited, lawful intervention in cases of imminent animal harm at federally regulated facilities, enhance whistleblower protections, and improve inspection responsiveness, and for other purposes.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.  
This Act may be cited as the “Animal Emergency Response Pilot Act of 2026”.

SEC. 2. PURPOSE AND LIMITED SCOPE.  
(a) This Act establishes a limited pilot program to improve the timeliness and effectiveness of enforcement under the Animal Welfare Act (7 U.S.C. 2131 et seq.).  
(b) This Act applies only to USDA-licensed or registered entities already subject to the Animal Welfare Act and engaged in interstate commerce.  
(c) Nothing in this Act expands the categories of animals covered under existing law.

SEC. 3. DEFINITIONS.  
(1) Covered animal — any animal regulated under the Animal Welfare Act.  
(2) Emergency condition — a condition where a covered animal faces imminent risk of serious injury, illness, or death.  
(3) Authorized officer — a USDA inspector or Federal law enforcement officer designated by the Secretary of Agriculture.  
(4) Qualified care entity — a licensed veterinarian, public shelter, or nonprofit rescue organization meeting federal standards.

SEC. 4. PILOT PROGRAM FOR EXPEDITED RESPONSE.  
(a) The Secretary of Agriculture shall implement a 5-year pilot program in a geographically diverse set of not fewer than 5 States.  
(b) The pilot shall test expedited procedures for inspection, warrant application, and emergency intervention.  
(c) The Secretary shall prioritize cases involving repeat violations or documented risk to animal welfare.

SEC. 5. EXPEDITED WARRANT PROCESS.  
(a) United States magistrate judges may issue inspection or seizure warrants within 24 hours upon sworn evidence of violations posing risk to animal health or safety.  
(b) Courts shall permit electronic and after-hours warrant applications under this section.

SEC. 6. EMERGENCY REMOVAL WITH SAFEGUARDS.  
(a) Authorized officers may remove animals pursuant to a warrant.  
(b) Warrantless removal is permitted only in exigent circumstances where delay would likely result in death or serious harm.  
(c) Judicial review shall occur within 24 hours of any warrantless removal.  
(d) All actions shall be documented and subject to audit.

SEC. 7. DUE PROCESS AND OWNER PROTECTIONS.  
(a) A hearing shall be held within 5 days of removal.  
(b) Owners shall have the right to notice, counsel, and presentation of evidence.  
(c) If probable cause is not established, animals shall be returned promptly.

SEC. 8. COST CONTROLS AND FUNDING.  
(a) Courts may require reasonable security from owners for care costs.  
(b) The Secretary shall establish a capped grant program to assist with unrecovered costs.  
(c) Priority for funding shall be given to cases involving confirmed violations.

SEC. 9. WHISTLEBLOWER PROTECTION.  
(a) Employees and contractors who report suspected violations in good faith shall be protected from retaliation.  
(b) Remedies include reinstatement, back pay, and damages.  
(c) Knowingly false reports are not protected.

SEC. 10. TRANSPARENCY AND REPORTING.  
(a) The Secretary shall submit an annual report to Congress on pilot outcomes, including response times, animal outcomes, enforcement actions, and costs.  
(b) Reports shall not disclose confidential business information.

SEC. 11. SUNSET AND EVALUATION.  
(a) The pilot program shall terminate 5 years after enactment unless reauthorized.  
(b) The Government Accountability Office shall conduct an independent evaluation and report to Congress within 4 years.

SEC. 12. RULE OF CONSTRUCTION.  
Nothing in this Act authorizes private individuals to enter property or remove animals without lawful authority.

SEC. 13. EFFECTIVE DATE.  
This Act shall take effect 180 days after enactment.
