Help Save the Boulders in the Sonoran Desert!

The Issue

Natural Boulders are an iconic feature of the Sonoran Desert providing priceless value to its residents. The Legend Trails Community Association threatens to remove beautiful bolder landscaping installed by one of its residents at considerable time and personal expense. The boulder landscaping installed along his property line prevents water flow and erosion onto his property from common area land owned by the Association. Neighbors believe his actions beautifies the neighborhood and enhances property values.


The HOA Board of Directors has directed the removal of the Boulders because they were not properly approved by the Board. Since the boulders infringe on common areas subject to a natural area open space (NAOS) easement, approval is also required by the City of Scottsdale. But the Board of Directors refuses to authorize an application required to achieve City approval of the desert landscape plan.


We the Undersigned, love the desert and respectfully call upon the Legend Trails Homeowners Association Boards to immediately refrain from taking actions to remove the Boulder Landscaping and cease and desist from pursuing legal actions in pursuit of its removal. We call upon you to authorize its member to seek desert landscape approval from the City of Scottsdale.  
We submit these demands because:


1.     These Board actions do not represent the wishes of its neighborhood members.


2.     The Boulder Landscaping enhances the aesthetic and property value of our neighborhood. 


3.     These Board actions have not been made public and available to its members.


4.     The Board has refused to seek a workable solution by authorizing its member to seek approval from the City of Scottsdale.


5.     The Board is discriminating against one of its members while allowing NAOS improvements on other common areas by members without approval from the Board.


6.     The Board's actions will waste homeowners’ dues to remove valuable assets provided at no expense to its members while risking the costs of litigation upon its members.


7.     The Board actions will further exacerbate the original erosion problems from the Association Common Area property.


8.     These Board actions discourage members from investing privately to further improve and enhance their homes and neighborhood.
These actions are an example of the heavy-handed enforcement of bylaws by community association boards that see their role as enforcers of rules rather than working to enhance the quality of our desert neighborhoods.


Desert boulders are a natural treasure that should be encouraged. Let us demand that our neighborhood leaders respect that! Please join our petition.
