The Issue

Shun Birch maintains he is unequivocally innocent. This petition calls for an independent review of the full record in his case #08CR10481, including critical jury materials and evidence he says was withheld. This is not just about one person. It is about whether truth can be buried inside the justice system while the public is denied a full and fair review. If transparency means anything, this case deserves independent scrutiny now.

Justice depends on fairness, transparency, and accountability. Shun Birch maintains he is unequivocally innocent and says key parts of the record in his case were buried, sealed, or mishandled while evidence favorable to his defense was not fairly confronted.

Case Violation Details

During jury selection, I contend 8-African-American prospective jurors were struck in a row, raising serious Batson concerns.

I further contend the court minimized that issue “ for the record, we can see she’s African-American” instead of fully confronting it Stating”Since neither side objected, and we will release the juror”That was the reason for the Batson Challenge Miss Bowers, my attorney had objected to the strike.

The only eyewitness described two suspects, not one

A detective was caught on tape saying, “We’re not going to turn this over, are we?” and the prosecutor answered, “No.”
Exculpatory eyewitness evidence was  withheld, mislabeled, and omitted

The lead detective also falsely claimed he never received Sprint records, but subpoenaed emails showed otherwise.

The same judge presided over both the grand jury and trial despite serious misconduct issues being raised.

The jury acquitted on key predicate findings, yet I was still convicted, raising double-jeopardy and inconsistent-verdict issues.
The jury instructions and verdict forms were sealed and then treated as unavailable for review.

The appellate court later received those sealed materials, yet the State still argued the record was missing.

My case reflects suppression of evidence, false testimony, and a record trap that has blocked justice for years.

No person should spend years fighting simply to have the full record seen. When serious questions are raised about evidence handling, jury materials, and transparency, the answer should never be silence. The answer should be scrutiny.

This petition calls for an independent review of the full record in the Shun Birch case, including sealed jury materials and the handling of allegedly withheld exculpatory evidence. The public deserves to know whether critical materials were properly handled and whether this conviction can stand without full transparency.

This case matters beyond one name. If the public cannot trust that all evidence will be fairly handled and all critical materials will be available for review, then public trust in justice is broken.
