The Florida Bar is the "arm" or agent of The Florida Supreme Court for attorney regulation and discipline. Within the Bar lawyer discipline is controlled by five individuals, the Chief Branch Disciplinary Counsels of the five branch offices located in Tallahassee, Tampa, Orlando, Ft. Lauderdale, and Miami.
It is illegal to practice law in the Sunshine State without being licensed by the Florida Bar. Furthermore, Florida’s Supreme Court regulates the bar and sets the rules of conduct, which means that anyone practicing law must adhere to the standards set forth by the court. . Lawyers who are beholden to the court’s standard of acceptable behavior find no outlet to mount any meaningful opposition to the fundamental question of the court’s power as exercised by individual justices facing merit retention.
As elsewhere in the United States, persons must pass morale character screening as administered by the Florida Board of Bar Examiners. Admission to the bar includes passing a background investigation, the Multi-State Professional Responsibility Exam and the Bar Exam, which tests both the common law and Florida law through written state essays and state-specific multiple-choice questions.
If a attorney passes the qualifications administered by the Florida Bar of Bar Examiners they may be granted a license to practice law in the State of Florida.
Attorney’s who are appointed by the State of Florida to practice law must up-hold the law and take an oath of office.
“I do solemnly swear:
“I will support the Constitution of the United States and
the Constitution of the State of Florida;
“I will maintain the respect due courts of justice
and judicial officers;
“I will not counsel or maintain any suit or proceedings which shall
appear to me to be unjust, nor any defense except such as I believe
to be honestly debatable under the law of the land;
“I will employ for the purpose of maintaining the causes
confided to me such means only as are consistent with truth
and honor, and will never seek to mislead the judge or jury by
any artifice or false statement of fact or law;
“I will maintain the confidence and preserve inviolate the
secrets of my clients, and will accept no compensation in
connection with their business except for them or with
their knowledge and approval;
“ I will abstain from all offensive personality and advance no fact
prejudicial to the honor or reputation of a party or witness, unless
required by the justice of the cause with which I am charged;
“I will never reject, from any consideration personal to myself, the
cause of the defenseless or oppressed, or delay
anyone’s cause for lucre or malice. So help me God.”
We the People being fully aware of the fact that attorney Jose baez did pass the tests as administered by the Florida Board of Examiners, he was appointed, and he took the oath of office to uphold the law.
We the People are also aware of the facts that the application that was originally filed by attorney Jose Baez to be admitted to the State of Florida Bar was denied by the State of Florida Bar and the State of Florida Supreme Court.
However, in 2006 Jose Baez again appealed to and filed an application with The Florida Board of Bar Examiners to be appointed to practice law in the State of Florida. He was approved and admitted to the State of Florida Bar and approved by the State of Florida Supreme Court.
The Florida Supreme Court and The Florida Board of examiners both being fully aware of the denial of the prior said application and request by Jose Baez to be admitted to the State of Florida to obtain a license to practice law in the State of Florida.
Since the appointment of attorney Jose Bar to practice law in the State of Florida in 2006 at least (9) complaints have been filed against Jose Baez with the State of Florida Bar Association. At least (6) of those complaints have been dismissed by the State of Florida Bar Association.
We the People who have a great amount of respect for the system of law and those who are given the legal rights to administer the law are questioning whether attorney Jose Baez is getting away with breaking the law and failing to uphold the oath of office he took to be admitted to the Bar in the State of Florida to practice law.
We the People also question whether the reasons and or failures to hold attorney Jose Baez accountable are a direct result of their appointment of him to practice law. They being fully aware of his first denial by the State of Florida and The Florida Supreme Court and the reasons for that denial that were based upon his past history and failures to meet his financial obligations to his children and abide by a Circuit Court order to pay court ordered child support. Also his past history of other financial obligations and his lack of professional conduct.
We the People have to question why attorney Jose Baez has had so many serious complaints and or allegations filed against him during his short time by the appointment of the Bar to perform duties in the State of Florida in the capacity of his position as an attorney.
We the People have noted some of the complaints and violations filed against attorney Jose Baez as very serious in nature. At least (2) of these complaints have been filed by sitting Circuit Court Judges in Orange County Florida.
We the People seeking justice are requesting a full investigation into the conduct of the State of Florida Bar Association as to their failure to address and or take seriously the numerous complaints filed with their department against attorney Jose Baez and furthermore request the at the conclusion of that investigation the results of that investigation be released to the public.
We have grave concerns as to whether The State of Florida Bar Association through will full misconduct have ignored complaints against Attorney Jose Baez because they are the tiers of fact when it involves the appointment of an attorney to the State of Florida Bar. The State of Florida Bar being fully advised and aware of issues and or concerns that existed against this attorney in a prior denial of admittance to the Bar .
We the People seeking justice see a very strange pattern of numerous complaints filed with the State of Florida Bar against attorney Jose Baez being dismissed. We do not want to assume anything, but we do question the reasoning behind this. Is the Florida Bar Association not taking the complaints seriously and or is there not enough evidence to support these complaints?
We the People seeking justice have the need to be assured the complaints that have been alleged against attorney Jose Baez are not being dismissed due to the fact that The State of Florida Bar appointed Jose Baez to the Bar with the expert afore knowledge that Jose Baez’s background and lack of responsibilities to adhere to and to follow court orders and up hold the law in his personal life lacked professionalism and put doubts into his credibility to be placed in such a position.
The decision to allow attorney Jose Baez admittance to the State of Florida Bar rested sourly upon the Bar to make a right and just decision concerning that appointment.
We also see a pattern of misconduct and failure to uphold the oath of office attorney Jose Baez took upon his acceptance to the State of Florida Bar.
We the People seeking justice request a formal investigation of the State of Florida Bar by The Florida Board of Examiners as to their conduct in the investigation in the numerous amount of complaints that have been filed against attorney Jose Baez. These complaints vary in nature as to violations alleged against attorney Jose Baez . The alleged complaints appear to be very serious in nature and have resulted in no sanctions against attorney Jose Baez
We truly hope the way the system is set up it does not produce biased results that favor the Bar as the "official arm" of the State Court, at the expense of what is morally and ethically correct. That decision made explicitly by the Bar does not therefore discount the application of justice against those they have appointed to uphold the oath of office and the law.
