Respected Madam, 

1. I resident of CHS Ltd located in CIDCO’s Kharghar Node, Navi Mumbai would like to register my/our strong objection to the proposed inclusion of Kharghar Node into the to be newly constituted Municipal Corporation of City of Panvel (MCCP) in terms of the Government of Maharashtra Urban Development Department Notification No. PNP-2914/VIP No. 301/CR-354/UD-23  dated 16th May 2016. We submit hereunder the reasons for our objection:- 

a. The State Govt. of Maharashtra with intent to decongest Greater Mumbai and to upgrade civic amenities decided to create the new township Navi Mumbai across the harbour. Therefore, in exercise of the power under Sub-section 1 of Section 113 of Maharashtra Regional & Town Planning Act, 1966 (MRTP Act), notified the site for New Town of Navi Mumbai. The State Govt. in exercise of the power under Sub-Section 3A of Section113 of MRTP Act appointed CIDCO to be New Town Development Authority for creation of New Town Navi Mumbai. After appointment of CIDCO as Town Development authority of New Town Navi Mumbai, CIDCO prepared a plan for development of Navi Mumbai covering 95 villages including Kharghar Node carved out of the districts of Thane and Raigad, covering a total area of 343.70 sq. km. Accordingly the land was acquired by CIDCO for development of City of Navi Mumbai.
b. CIDCO had planned and developed/is developing the New City of Navi Mumbai within the acquired land from both the districts of Thane and Raigad.  The CBD Belapur, where the headquarters of Navi Mumbai Municipal Corporation (NMMC) has been located is at the Centre of all the Nodes planned out of land acquired from Raigad and Thane Districts. In addition to the Headquarters of NMMC, the Commissionerate of Navi Mumbai Police is also located in Belapur.
c. CIDCO has leased each and every plot of land at high premium to residents of Kharghar Node with the Promise that it will be part of Navi Mumbai, with facilities of cities of International Standards. With this Promise from the Government of Maharashtra all Citizens of Kharghar have purchased the properties in Kharghar Node of Navi Mumbai.
d. Kharghar Node is well connected to Belapur by road and major portion of Navi Mumbai Metro rail will run through Kharghar Node which connects to Belapur. Kharghar is being developed as a Model node of Navi Mumbai with international standard infrastructure with projects such as Golf Course, Central Park, Metro rail, International Airport, Business Park, Community Centre, Film city on the Hills etc.
 e. Implementation of these projects and being a part Navi Mumbai, which would be a well spread out and planned city was the main attraction for most of us coming from various parts of Mumbai and country to acquire apartments, shops and other properties in Kharghar.
f. The urban and cosmopolitan nature of the residents of Kharghar Node will not be in sync with the major portion of the area to be included in MCCP.
g. CIDCO was mandated to develop the Nodes fully with all the facilities and handover such fully developed Nodes to NMMC. Accordingly, CIDCO has handed over Nodes of Vashi, Sanpada, Turbhe, Koparkhairne, Airoli, etc to NMMC. Kharghar Node is yet to be handed over to NMMC as it has not been fully developed as per the proposed plan.
h. Presently, development of Kharghar Node is only complete to the extent of 40% of total planned. CIDCO has levied and collected various charges based on the Promise of Implementation of these projects of international standard. Inclusion of Kharghar in MCCP would deprive the Residents of Kharghar Node the benefits of the projects for which we have paid our hard earned money to CIDCO with the Promise of being part of Navi Mumbai.
I. After the full development of all 45 sectors of Kharghar Node, which will take another 4-5 years, the population of Kharghar Node will be well beyond 5 lakhs which will make Kharghar Node  eligible to be included in Navi Mumbai as it is done in case of other developed nodes of Navi Mumbai. It is mandatory on the part of CIDCO to handover the Kharghar Node to NMMC on completion of all development work. 

2. In view of the afore-mentioned reasons, it is amply clear that the Promise was that Kharghar node will be part of Navi Mumbai. It would be a grave “Breach of Trust” by the Government of Maharashtra with the citizens of Kharghar, if Government includes Kharghar in MCCP. This is also unlawful. 

3. We, therefore, strongly reiterate our Objection to the proposed government intention to include Kharghar in MCCP. 

4. Alternately, the proposed Navi Mumbai  South Smart city, as announced by the Chief Minister on 4th Dec 2015 at Vashi, with planned outlay of Rs 34,000 Crores be fully developed and be named as Navi Mumbai Muncipal Corporation,(South) - NMMC(S).
