The Issue
The 54 acre property to the east of East Cobb Park is under contract to a developer that wishes to rezone the property from R-20 to Counting Care Retirement Community (CCRC). They plan to build a very large and dense senior living facility which would not fit the character of East Cobb. The developer, Isakson Living, was part of the committee which formed the CCRC code in 2008, while simultaneously negotiating for this same parcel of land. We believe that the CCRC code is heavily weighted in favor of the developer. Zoning codes should allow reasonable development, while also protecting the interests of the adjacent neighbors and the wider community. We believe the CCRC zoning code highly favors the developer over neighbors, who are homeowners, tax payers and voters.
The following are specific proposed changes to the CCRC code:
1.A CCRC shall not be allowed in Low Density Residential (LDR) or Very Low Density Residential (VLDR) areas as shown on the future land use plan. It is already not allowed in Rural Residential (RR) areas.
2.For CCRCs in NAC, MDR, and P/I areas as shown on the future land use plan, the maximum building height shall be 35 feet above grade.
3.No floodplains, wetland areas or cemeteries may be used in calculating the overall density of the development.
4.The CCRC must be within five miles of an acute medical care center, by the roads customarily travelled by emergency response vehicles.
