Why this petition matters

As a Luckey Ranch home owner I would like to petition our community to join together in order to be released from a contract First residential signed.
According to our HOA bylaws section 3.21 if the association or governmental entity does not provide for garbage and other waste collection each owner shall contract with an independent collection service for the purpose of disposing of trash, litter, refuse, manure, and other waste.
Which means HOA must PROVIDE meaning pay. Since HOA dues are not paying for our trash service we are allowed to use who we do choose. However TDS is threatening the other trash companies with legal ramifications.
Referring back to the bylaws 3.21 Each lot shall be kept so that it is not unsanitary, unsightly, offensive, or detrimental to any lot or resident.
Being that TDS only comes once a week for trash and every other for recycling, there are many times bins are over flowing. On numerous occasions TDS has failed to pick up at all and has left us in unsanitary conditions.
This petition allows the residents of Luckey Ranch to show the displeasure and loss of faith in the current trash services. As we never signed a contract with the company we should be allowed to pursue other independent companies per 3.21 in the HOA bylaws. This would not only allow for more competitive pricing and service to the community, but also allows financial flexibility to people whom may be suffering any financial hardships due to the unprecedented times with COVID.
