Deny parole to child-murderer Armando Soto, and keep his projected release date February 8, 2029.
The Issue
The early release of child-murderer Armando Soto poses an imminent danger to society in general, and to children in particular.
Armando Soto murdered an 18 month old child, Adam Barboza on February 7, 1989, and is a candidate for parole after having served only 25 years out of a 40-year sentence.
Soto’s past criminal records – possession of controlled substances, theft of a motor vehicle, in addition to the murder of an 18-month year old child – do not lead us to believe that he will constructively adjust to society despite any training, instructions, or development given in prison. Soto will not be an asset to our community, but rather a threat to society -- particularly our children and future.
According to the Cook Fort Worth Chlidren’s Medical Center Examination: “In conclusion, we have a case, in my medical opinion, that this was unequivocally a form of child abuse. This is also agreed for by the medical examiner”, as stated by Barry Evans, M.D. and consigned by Gordon Paul, M.D.
Because the medical examiners state that this is “unequivocally a form of child abuse”, we can conclude that it was a conscious decision for Armando Soto to “intentionally with the intent to cause serious bodily inury to Adam Barboza, commit an act clearly dangerous to human life, namely, strike the said Adam Barboza against the floor, strike the said Adam Barboza against the wall, strike Adam Barboza against an object to the grand jury unknown, and strike the said Adam Barboza with an instrument to the grand jury unknown, which caused the death of Adam Barboza” (according to the official Criminal Docket of the Criminal District Court of Tarrant County, Texas) – which lead us to further question his mental stability, his ability to feel compassion enough to not murder an innocent child, and his basic respect for human life; please remember that Adam was murdered, and so Armando has already showed he is capable of not just murder, but the murder of a baby.
Moreso, during the autopsy, examiners found other fractures and hematomas that could not be explained by the murder itself. These examiners suggest a history of abuse which the baby, Adam, had to endure during his 18-month lifespan – including lacerations to the liver, fractures to the clavicle and ribs, and even the deformity of a femur which appeared to have had a fracture at least 10 days to 2 weeks before his murder – and “does not constitute an explanation for the current findings”; meaning, there were other fractures and injuries found in Adam’s body that existed long before his murder; he was abused up until his death. Armando Soto abused Adam up until his death; Soto is thus unstable, habitually abusive, and ultimately a murderer.
We thus ask that you consider honoring justice for Adam by honoring Soto’s original 40-year sentence. At the time of the murder, Texas legislation did not have a set punishment for child abuse; now, in 2014, this type of child abuse – specifically, abuse that is murder – would require, at minimum, a life sentence; a 40-year sentence, in comparison to a life-sentence, would still be generous in comparison to the life sentence Soto could have had.
Adam’s death certificate cites “Craniocerebral Trauma” and “Beating of Head with Blunt Object(s)” as the official immediate cause of death, as signed by Nizam, Peerwani, M.D., the Chief Medical Examiner of Tarrant County. Both Laboratory Reports and the Nursing Observation Record identify the case as “child abuse”.
By signing the petition, you restore justice to an irreversible act of violence; you keep society safer by keeping out a proven murderer; and ensure that there is “justice and liberty for all”. Thank you for your time, thought, and signature.
