The Issue
Hi my name is Tommie Gill and I came in to Tempe Kia in Tempe, AZ for an oil change because my car warranty covers free oil changes at any Kia Dealership. I came from Las Vegas because none of the Las Vegas locations had availability for at least a week and I was able to book one at their dealership at 4pm on July 8th. I came in for an oil change and everything seemed ok. I left, met a friend and had lunch. I left for Las Vegas after filling up at Costco. I was in Mohave County near Kingman and I notice a sound from the left front side. I got home and went to Jim Marsh Kia and talked to Bailey Trevino. I had to leave the car their for about a week. I rented a car until Wednesday, July 14th. Bailey told me on Tuesday, July 13th, the car was not ready and I rented another can until Friday which was July 16th. Wednesday Bailey told me that the car front left tire lug nut wasn't tighten and it cause that tire and rim to get damaged, the brake pad and rotor, & the alignment. I told then that Tempe Kia was the last place I went to for an oil change. Before that was Towbin Kia in June for my last service. Bailey told me to contact Tempe Kia and send proof of the invoice because he believe whoever did the service at Tempe Kia did not make sure the bolts were tighten on the car which caused damage in the left side of the Optima. Because I was replaced one tire. I decided to place the other 3 tires because it would have thrown the other tire off the wear and tear would have been off. Because of not having my car. Friday, July 9th, I was able to get a ride to work and back home by my boss and a friend. Saturday on July 10th, I had to spend $31.01 on a Lyft from home to the McCarran Airport Rental Car Center to rent a Chevy Spark from Enterprise which was $304.31 to rent until Wednesday, July14th. Enterprise did not have any more cars and that rental I had with them needed a oil change and had a air leak in the right rear tire. I got a car with Budget and the Ford Mustang was the cheapest car they had. I got extra insurance on the car because Mustangs attract bad people. I ended up spending $365.25 on that car. I caught a Uber on July 16th to Jim Marsh Kia which was $34.21. To get my car out the shop, I had to spend $3, 033.39. I take responsibility for three of the tires with tax is $438.00. The front rotors and the brakes. I believe the right side is on me. The left side where is damage is not my fault. The alignment was done on the whole car. I take responsibility on the back alignment and even the front right tire if y'all don't take responsibility. The left tire where the alignment was not caused by me.I sent pictures of the invoices. If this did not happened. I would not be out of about $3768.17. I contacted Scott Purtle at Tempe Kia who is the Service Manager there and he denied any wrongdoing. I contact my lawyer in Henderson named Dempsey Roberts & Smith and they transferred my complaint to a Mesa, AZ who I use to deal with when I lived in Phoenix named Davis Miles McGuire Gardner. They need a statement from me which I gave them. They needed a statement from Jim Marsh Kia that is on a company overhead with a statement. Bailey promised he was going to help me on August 13, 2021 with that and I waited a week and heard nothing. So on August 20, 2021, I go there and he tells me he can not get involved in the matter. I can not pursue them with a statement from Jim Marsh. I will be out of 3768.17 if I don't give up and fight this to the end. If Jim Marsh does not want to help me go after Tempe Kia, then they need to pay me what Tempe Kia owes me because I was taken advantage of by both parties.
