Urgent: this Friday, Nov 7th, The Supreme Court will consider whether to take up the appeal of former Kentucky county clerk Kim Davis, who has directly asked the justices to overturn the landmark 2015 decision that extended marriage rights to same-sex couples nationwide. In 2015, the Supreme Court affirmed in Obergefell v. Hodges that same-sex couples have the fundamental right to marry — a landmark decision that brought dignity, equality, and legal security to millions of Americans. That ruling was a promise: love is love, and our laws must treat it that way.
Now, Kim Davis, the former Kentucky county clerk who refused to issue marriage licenses to same-sex couples, is asking the Supreme Court to not only hear her case but to revisit and potentially overturn Obergefell. If the Court takes this appeal, it could open the door to dismantling hard-won marriage rights nationwide.
Davis was found liable for violating the constitutional rights of couples she denied, resulting in a $100,000 damages award and over $260,000 in attorney’s fees. Rather than accept that accountability, she — with the backing of a well-funded advocacy group — is pushing a dangerous argument that the right to marry should not exist for same-sex couples at all.
This is not just about one person’s actions in a small Kentucky county. It is part of a broader movement in at least nine states to roll back marriage equality. If the Supreme Court takes this case and overturns Obergefell, each state would once again decide who can marry — erasing decades of progress toward equal treatment under the law.
Two-thirds of Americans — across political, religious, and regional lines — support marriage equality. That consensus reflects a shared belief in fairness, dignity, and freedom from government interference in our most personal relationships. The Supreme Court must respect that consensus and the precedent it set.
We call on the Supreme Court to reject Kim Davis’s appeal in full. Protect the constitutional right to marry for all couples, regardless of gender. Keep the promise made in Obergefell: that love and equality are not up for debate.
