The Issue

The U.S. Senate is considering a dangerous and unnecessary bill called the No Rogue Rulings Act (NORRA) — a law that would severely weaken the power of federal courts to stop illegal or unconstitutional actions by the president.

But here's the truth: The Supreme Court has already ruled.

In a 6–3 decision at the end of its 2025 term, the Supreme Court found that lower courts likely overstepped their authority by issuing nationwide injunctions — the very practice NORRA aims to eliminate. Justice Amy Coney Barrett wrote that such sweeping injunctions go beyond what Congress allows. The Court’s ruling already limits how far judges can go in blocking executive orders.

So why is Congress pushing a law to do what the Court has already done — and more?

NORRA would go beyond the Court’s decision and permanently strip federal courts of tools they need to protect people’s rights. It would:

Undermine the constitutional balance between branches of government
Make it harder to stop unconstitutional executive actions before they do harm
Set a dangerous precedent for future presidents of any party
We don’t need to break the courts to score political points. The system is already adjusting — NORRA is overkill.
