Talley Fields Home Owner’s Association Petition
The Issue
The current Talley Fields Home Homeowner’s Association Board (controlled by the Subdivision Developers) sent out an email yesterday 10/20/22 giving all of us Current Homeowners less than a week’s notice to show up at a Homeowners board meeting where our interests and opinions will be unrepresented if we don’t call out of work at 11:00am to show up for the meeting. The reason the current Talley Fields HOA board members are giving for calling this meeting is to vote on a 10% increase to our HOA assessment.
If we do not represent ourselves, opinions, and disagreement the current HOA board will get what they want by default. The purpose of this petition is to represent our denial of any increase in association dues or assessments at this time, call the current board out for not following Texas Property Code laws with being transparent about the accounting and Records of the HOA (how they are collecting and spending our money) and to take control from the current board which is comprised of all NON HOME OWNERS.
Currently, the HOA is failing to upkeep common areas of of subdivision, is allowing the builder and builder contractors to leak oil, litter, spread debris, and wreck general havoc in our developing neighborhood.
This petition is for us to:
- Formally request the HOA to reveal the records and accounting of the fees we pay them monthly and how they are being allocated.
- Disagree with the 10% Assessment fee increase at this time since we are not represented by the Talley Fields HOA board
- Formally alert the board that we are unhappy with their lack of fulfilling HOA duties in spite of us all paying out HOA dues monthly and yearly.
An HOA's responsibilities ordinarily include paying for the operation, maintenance, repair, and replacement expenses for all the common areas in the development. Expenses might include the costs of keeping a common pool cleaned and maintained, or paying for heating, lighting, and cleaning a common clubhouse.
The HOA adopts an annual budget, which usually includes the cost of all ongoing maintenance and operation expenses, plus an additional amount for a reserve fund.
Chapter 209 is known as the Texas Residential Property Owners Protection Act and establishes standards applicable to records retention, member notices, voting, assessment collection, and foreclosure, among other things.
TEXAS RESIDENTIAL PROPERTY OWNERS PROTECTION ACT
Sec. 209.005. ASSOCIATION RECORDS. (a) Except as provided by Subsection (b), this section applies to all property owners' associations and controls over other law not specifically applicable to a property owners' association.
(c) Notwithstanding a provision in a dedicatory instrument, a property owners' association shall make the books and records of the association, including financial records, open to and reasonably available for examination by an owner, or a person designated in a writing signed by the owner as the owner's agent, attorney, or certified public accountant, in accordance with this section. An owner is entitled to obtain from the association copies of information contained in the books and records.
