Take action against paternity fraud

The Issue

I am asking Colorado lawmakers to reform parentage laws and remove the statute of limitations that prevents innocent individuals from challenging paternity when DNA evidence proves they are not the biological parent.

In my family’s case, DNA testing established that my husband is not the biological father of a child he raised and supported for years. Despite this evidence, the courts refused to consider the truth because of procedural deadlines and statutory limitations. The result was that scientific evidence was ignored, and legal obligations continued to be enforced against a man proven not to be the biological father.

No one should lose the right to seek justice simply because they discovered the truth too late. Fraud does not become truth with the passage of time.

We are calling for Colorado to:

Remove time limits that prevent courts from considering DNA evidence.
Require evidentiary hearings when credible genetic testing excludes paternity.
Allow parentage orders obtained through fraud, misrepresentation, or mistake to be challenged at any time.
Establish legal remedies for victims of paternity fraud.
Protect every child’s right to know their biological parentage.
Hold accountable those who knowingly provide false information regarding paternity.
This issue is bigger than one family. It affects parents, children, and public confidence in the justice system. Courts should be empowered to determine the truth, not prevented from hearing it.

If DNA evidence proves a person is not the biological parent, the law should allow that evidence to be heard regardless of how much time has passed.

Please support reforming Colorado’s parentage laws and ending the statute of limitations that shields paternity fraud from judicial review.
