Seeking Financial & Moral Support of Hon’ble SC (save the dignity of Advocates)

Hon’ble Judges,

Being an Advocate we would like to draw your kind attention. The Nationwide lockdown has brought to the fore the great disparity in the legal profession & lockdown has financially damages lawyers.

Legal profession is considered a noble profession as it is the upholder and protectorof law. The problem is more with young lawyers & first generation lawyers who have no financial support. Lawyer’s mental health is taking a hit as a result of the coronavirus epidemic (Financial Crisis). Young lawyers are same like daily wage workers along with Law Degrees. Young Female lawyers are also suffering & effected with Lockdown unable to pay their Rents and buy daily households.

The Bar Council of India appealed to Hon’ble PM on ( March 2020) to provide Rs 20,000 as minimum subsistence allowance per month to lawyers who are not financially well off so that they can support their families following the lockdown due to coronavirus epidemic.

The Bar Council of India (BCI) on April 23 announced a financial scheme for lawyers. However, the same serves no purpose as the amount to be disbursed has been still undecided and pending. 

The Hon’ble Supreme Court (April 2020 ) refused to entertain a petition which sought exemption to advocates from payment of rent for their offices/chambers during lockdown.

As a measure of social security for practicing advocates, setting up of welfare funds by the central and state governments is mandatory under the Advocates Welfare Fund Act, 2001.

The SCBA (April 2020) has established a scheme entails providing a loan of Rs.25,000/- without interest to a member who are facing difficulties due to the national lockdown. The scheme is against the objective of  Advocates Welfare Act 2001.

The Advocates Act 1961 also doesn’t permit to practise any other profession for livelihood.

We Advocates play many vital roles by preserving, protecting & perpetuating the rights of citizens, if our life will suffer how we can protect others rights?Advocates are also officers of the courts and play a vital role in the administration of justice under section 49(1)(c) of the Advocates Act,1961.

This is our humble request to protect our life & Dignity by providing us monthly Financial Assistance of Rs 25000 & any other relief which Hon’ble Court may think fit. Lawyers are like a family member of the Court, we seeks/need Financial and as well as Moral Support of Hon’ble Court in epidemic crises.
