The present Petition under Article 32 of the Constitution of India is being preferred by the petitioner for seeking appropriate direction against the usage of words “chhakka”, “Hijra”, or any other derogatory words, and to determine a dignified name to address Transgender people, further for interpretation of section 2(k) of Transgender persons act 2019, where a transgender person has been defined as a Hijra which is again Humiliating and degrades the dignity of Transgender person. Article 14 & 21 of the Constitution of India guarantees equality before law and protection of life and personal liberty that includes the Right to Dignity. In the situation when the words like “Hijra ,Chhakka” are used to address a transgender person leads to hampering the dignity of the transgender person, which furthermore leads to hampering their mental health, thus the same is violative of Article 21 of the Constitution of India that clearly includes Right to Dignity The ban of such derogatory words used against Transgender community will help them with a fruitful life with dignity and will also help them to maintain healthy mental health.
