Support Staff Sgt. Ryan Carter: Urge the Supreme Court to Hear His Case Against the DoD

The Issue

On April 6th, 2018, Staff Sergeant Ryan Carter walked into Walter Reed National Military Medical Center for a common back surgery meant to alleviate chronic neck pain. Now he will never walk again.

A former information technology airman for the Maryland Air National Guard, Ryan now has limited use of his left arm but is otherwise paralyzed from the chest down.

Hoping to receive compensation for alleged medical malpractice, Ryan’s family filed a civil lawsuit using the Federal Tort Claims Act. Ryan was not on active duty or medical orders at the time of the surgery.

82 days after Ryan’s surgery, the military changed his orders status to active duty and backdated it to March 14th, 2018 – an alternation that disallowed a civil lawsuit due to the Feres Doctrine, the federal ruling that bars active-duty service members from suing the government for injuries.

On June 5th, 2024, Ryan’s attorney, Chris Casciano, filed a petition on behalf of Ryan with the Supreme Court.

The Court has asked the government to respond to the petition. What does this mean for Ryan??

It means that the Court might choose to hear his case. 

OUR REQUEST: Sign this petition requesting two things:

  1. The Supreme Court of the United States hear Ryan’s case. This will give Ryan an opportunity to earn a victory he and his family so justly deserve.
  2. Contact your congressional representatives and ask them “Sir/Ma’am, how did we get here? Why was the Department of Defense allowed to unscrupulously BACKDATE Staff Sergeant Carter’s orders just to make sure that he will not receive just compensation for alleged medical malpractice that has left this young man paralyzed from the chest down?!”
