The Issue

This Isn’t About Banning Alcohol. It’s About Banning Drinking and Driving.

We’re not trying to shut down bars.
We’re not trying to take away your freedom to enjoy a drink.

But if your “freedom” ends someone’s life on the road, then we have a problem.

Drinking and driving is a choice.
And it’s time our laws and our courts start treating it that way.

What’s Broken — And What Must Change

🚫 Slaps on the wrist for DWI deaths
🚫 “First-time” excuses after a life is taken
🚫 Repeat offenders allowed back on the road
🚫 Victims forgotten while offenders walk free
🚫 No safeguards in place to catch impaired drivers before it’s too late

We’re Demanding Real Change:

 

1. Lower the Legal BAC Limit

   Reduce the legal BAC limit in Texas from 0.08% to 0.05% to align with evidence based deterrence standards.

 

2. Bond Reform for DWI Offenses

 

   Establish a minimum bond of   $150,000 for felony DWI offenses.

    Require zero bond eligibility for any DWI offense involving a fatality until formal indictment and trial setting.

 

3. Felony Reclassification

 

  Reclassify intoxication manslaughter from a second-degree felony to a first-degree felony when aggravating factors are present, including fleeing the scene or the presence of minors.

 

4. Mandatory Chemical Testing

 

  Require automatic and immediate toxicology testing in all crashes involving serious bodily injury or fatality.

 

5. Elimination of Probation in Fatal DWI Cases

 

 Prohibit deferred adjudication or probation for defendants convicted of DWI offenses resulting in death.

 

6. Strengthened Enforcement of the Texas Dram Shop Act
