Enhanced Criminal Penalties for Synthetic Opiates: SB25-044 aims to impose stricter criminal penalties for the manufacture, distribution, and possession of synthetic opiates such as fentanyl, carfentanil, and benzimidazole opiate. This will help deter the illegal distribution and use of these dangerous substances.
Improved Public Health and Safety: The majority of Fentanyl deaths are caused by the victim not seeking or aware Fentanyl was in the substance they asked for. By targeting synthetic opiates, this bill will contribute to reducing the prevalence of these harmful drugs in our communities, thereby enhancing public health and safety.
Consistency in Legal Penalties: Colorado seized more than 2.7 million “fake pills” in 2024, according to the Drug Enforcement Administration’s Rocky Mountain Field Division (DEA RMFD). The bill repeals weight- or circumstance-dependent penalty provisions, ensuring that any amount of a qualifying controlled substance is treated as a level 1 drug felony. This consistency in legal penalties will help streamline the judicial process and ensure fair treatment.
Support for Rehabilitation: SB25-044 includes provisions for vacating drug felony convictions upon successful completion of community-based sentences, promoting rehabilitation and reintegration into society.
