Support HB 5108 to remove unfair restrictions on ticket resale

The Issue

Michigan sports and music fans deserve the right to buy and sell tickets on their own terms.

The state’s current law unfairly blocks fans from reselling their tickets above face value. That means if you purchased an event ticket and can’t attend, you can’t recoup the cost of all of the convenience fees, shipping charges and other fees that companies like TicketMaster pile on to the price of a ticket. In other words, Michigan law requires fans to resell their tickets at a loss!

Under the current law, people can actually get arrested for reselling above face value, which makes Michigan one of only a handful of states wasting law enforcement resources on blocking fans from reselling their own property.

House Bill 5108 would bring Michigan in line with the rest of the country and allow fans to freely buy and sell tickets in an open and fair secondary market. This bill will take the common practice of ticket resale out of the shadows and into the legal marketplace where sales will be subject to the state’s existing consumer protection laws.

Big venues and professional sports teams are trying to block HB 5108 because it takes away their ability to squeeze more profits from the wallets of fans. Michigan’s current resale law allows them to force fans to resell tickets either for a loss or through a designated company like TicketMaster or StubHub. They grant a monopoly to one of these companies in exchange for kickbacks that come from the fees paid by fans.

HB 5108 would end this state-protected monopoly, allowing fans to freely resell their tickets between one another.
