The Issue
Victims of fomer Menominee County Sheriff's deputy Brian Helfert (who was charged and plead guilty with multiple counts of Criminal Sexual Conduct in the First degree regarding numerous victims) are still coming forward.
If Judge Mary B. Barglind accepts the plea and sentence agreement orchestrated by Prosecutor Jeffrey Telton Rogg. This corrupt bargain denies any and all new or unknown victims their due process and the ability to pursue justice in ANY future cases made known. This sentencing agreement (if Judge Mary Barglind accepts it) would be levied in direct violation of each of the Victims' constitutional rights under -Article I Section 24 as it is unfair and not respectful of future victims especially as they would be not even known yet (and therefore impossible to respect if not known) AND -Article III Section 2 of the Michigan State Constitution as any agreement of the plea to erase or shorten the statute of limitations mandated, said plea would in fact be changing the law set by the legislation. A member of the Judiciary may not and CANNOT change a law set by Legislation.
Therefore changing the length of ANY mandatory legislative statute of limitations for ANYBODY for ANY crime (especially if charged with Criminal Sexual Conduct in the first degree which has NO statute of limitations). Judge Barglind if doing so would be obviously exercising a power that she does not possess as a member of the Judiciary over another branch of government. Such crossing power of another branch of government is not allowed in our Constitution, so therefore the plea as it sits IS ABSOLUTELY Unconstitutional.

It seems Judge Mary B. Barglind in this case has at least preliminarily warmed to this corrupt bargain saying it was “fair” to the local media in support of the District Attorneys illegal plea. This plea agreement, which states that no future victims who come forward in the future may persue justice against Brian Helfert who has committed decades of RAPE, ignores the fact that the Michigan Legislature decided that there would be no staute of limitations for Criminal Sexual Conduct in the First Degree.
Judge Mary B Barglind and Prosecutor Jeffery T. Rogg are violating the legislatures perogative by preventing future victims of Brian Helfert from having their day in court. This is a direct contravention to Article III Section 2 of the Michigan Constitution relating to separation of powers. It is not up to Rogg or Judge Barglind what the statute of limitations is for criminal sexual conduct in the first degree. The Michigan legislature has spoken on that topic, and they stated THERE IS NO STATUTE OF LIMITATIONS FOR CRIMINAL SEXUAL CONDCUT IN THE FIRST DEGREE. Therefore any plea of this nature would be unconstitutional and NULL and VOID on its face.
Helfert's sentencing is presently set for March 6, 2023. If Judge Barglind permits Prosecutor Rogg's corrupt bargain this would be the polar opposite of “fair” or “respectful” treatment of the victims and would violate their article 1 section 24 constitutionally protected rights under the Michigan Constitution. Judge Mary Barglind's rejection of this sentencing agreement is the Victim's last hope of holding Brian Helfert accountable for the generations of trauma he caused on the vulnerable and at risk male youth population of Menominee County.
Jeffrey T. Rogg, whom after multiple requests from various parties to recuse himself in this matter due to his many years of friendship with the Defendant Brian Helfert, refused to do so, and then entered into this corrupt bargain to keep Helfert from exposing just how deep his sexual abuse of minors ran and just how many leaders of Menominee County were/are involved. This plea agremeent is against the wishes of the majority of the populace of Menominee County, the individuals Mr. Rogg took an oath to protect and serve.
Rogg's conflict of interest is so obvious that many constituents claim there is a self serving personal interest on behalf of Rogg and/or other officials, and that he/they are more concerned with protecting themselves from criminal and civil liability than they are with acheiving justice for the children who Brian Helfert raped.
This is a notice of petition to hereby let the County, State and other Federal Officials involved know that We the People, Citizens of Menominee County and The State of Michigan intend to persue civil cases against the Defendant and any other person(s), officers or officials who aided Helfert and/or obstructed justice this case: including pursuing any bonds held by those persons.
Other Officials who Criminally Obstructed Justice in this case are currently being evaluated for criminal complaint referral(s). Not by Rogg, but by entities that are not conflicted out of representation due to their personal connections to Helfert, his Criminal Co-Conspirators and/or the financial motivations for covering up the extent of his crimes.
Were Judge Barglind to permit this corrupt bargain between Rogg and Helfert to proceed, the bonds that will be claimed for forfeiture include but are not limited to those of the Judges of the 41st Circuit Court, the Prosecutor, Sheriff, Undersheriff, Prior Sheriff, and any other Complicit Officials, Detectives and/or officers of this case whom did not honor their oaths and/or obstructed Justice in the investigative process. (If the actual sentencing reflects the protection of the victims 24th Amendment Rights and does not bar any victims' future complaints from being heard in court pursuant to the State of Michigan Constitution, then the Judge would be omitted from said list)
Conduct or omissions made by public officials that constitute a breach of their duties of the office or Constitution (which this unjust plea deal does) revokes their office’s immunity and relinquishes their bonds. Bonds which are called upon make each official PERSONALLY and FINANCIALLY LIABLE for their misconduct in office. In The State of Michigan these bonds serve as a guarantee of protection for constituents against fraud or dishonesty perpetrated against them by those they entrust the powers of governent to. These bonds cover losses arising from dereliction, neglect, obstruction and/or other serious offenses on behalf of the community and the victims of the Menominee County Sheriff's Office, Prosecutor and/or Administrations obstruction.
IMMEDIATE ACTION is required to let ALL victims (past, present and future) know that We the Constituents and Citizens whom make up the Community of MENOMINEE COUNTY as a whole in fact, WILL PROCEED to PROTECT ALL of our community members and constituents against all crimes and WILL NOT TOLERATE ANY CORRUPTION, dereliction, neglect or obstruction.
I call on all residents of Menominee County, all residents of the State of Michigan and all true Americans to signal their support for the victims of Brian Helfert by signing AND SHARING this petition. The Victims of Brian Helfert did nothing wrong and they ALL deserve their day in Court.
Jeffrey Rogg should recuse himself for many cited conflicts of interest and refer the prosecution of Brian Helfert to an unconflicted prosecutor. Furthermore Judge Mary Barglind should reject the corrupt plea agreement and set Brian Helfert for trial on the charges of Criminal Sexual Conduct in the First degree for which he was bound over to circuit court on.
Thank you fellow Americans for supporting the Victims of Brian Helfert and taking a stand against the corruption that is occouring in Menominee County.
