While we cannot change the past, we have the power to reshape the future. One where our most vulnerable are cared for and protected with the love and support they deserve. Our journey has lead us to this moment: we can either accept things as they are or come together to create real change for the most innocent children who suffer from birth injuries. Now is the time!
Our beautiful, little grand daughter Ayla was born in August 2020. Her name means Halo around the moon. Her light and love fill our hearts everyday and it will be our gift to her that through all her suffering something good will come of this most painful journey.
Ayla has stage 5 Quadripeligia Cerebral Palsy.

Petition: “Support Families Impacted by Birth Injuries/Medical Malpractice While Empowering Doctors for Safer Care”
In Canada, the Canadian Medical Protective Association (CMPA) exists to defend the liability of doctors in Medical Malpractice cases, including devastating birth injuries. While this organization provides legal support for healthcare providers, the current system often leaves families of children who have suffered from preventable birth injuries to endure long, costly, and emotionally exhausting legal battles. The CMPA’s tactics favour protecting doctors at all costs, while families seeking justice and compensation are forced to bear the brunt of prolonged litigation.
This must change!
The CMPA, which is funded by taxpayer dollars through the OMA (Ontario Medical Association) rebates to physician membership fee’s (in some provinces up to 90%) should focus not only on protecting doctors but also on ensuring that families impacted by medical negligence receive the support and compensation they need and deserve. The current system fails to adequately support these families while placing an unnecessary financial strain on taxpayers, who ultimately fund the CMPA’s vast legal reserves.
We call for the following reforms to the CMPA’s mandate:
1. **Shift Focus to Families Impacted by Birth Injuries/Medical MalPractice:**
The CMPA should make it easier for families affected by birth injuries to receive fair and timely compensation.
As in Japan, the focus is on the child’s future care, rehabilitation, overall well-being. This contrasts with the CMPA’s more adversarial stance, which can leave families fighting an uphill battle.
Rather than protecting doctors at all costs, the organization should ensure that families are able to access the care and support their children need without being trapped in drawn-out legal processes. The first 5 years of a Birth Injury is critical for therapies and rehabilitation to give the child their best chance at a life.
2. **Prioritize Mediation and Fair Settlements**: The CMPA should focus on settling cases through mediation rather than engaging in protracted court battles. This would not only reduce legal costs but also expedite the compensation process, allowing families to receive support more quickly. The CMPA should be held accountable for the legal expenses incurred in cases where an earlier settlement would have been more cost-effective.
3. **Taxpayer Savings and Efficiency**: By minimizing legal expenses and encouraging faster resolutions, the CMPA can reduce the financial burden on Canadian taxpayers. Instead of prolonging cases to protect doctors’ reputations, the system should prioritize efficient settlements that help families receive compensation in a timely and fair manner.
4. **Promote Accountability and Transparency**: Medical errors should be openly acknowledged, and healthcare providers should learn from these mistakes to improve future care. The CMPA should work alongside doctors to create a culture of accountability, ensuring that families impacted by Birth Injuries/Medical Malpractice receive the truth and support they deserve. A doctor’s professional reputation should not be prioritized over the needs of victims, especially when admitting mistakes and assisting families in securing compensation can foster trust and enhance the healthcare system.
