Support Equal Parenting Rights in South Africa ✊⚖️👶
The Issue
Every Child Deserves Both Parents ❤️🏡👨👩👦 Sign this petition to urge the South African Parliament to amend existing laws and ensure unmarried fathers have equal parenting rights, including shared primary residence, meaning equal custody and time-sharing of the child as the default assumption, recognizing that it is in the best interests of the child unless proven otherwise. ✍️📜✅
The Problem ❌⚖️💔
Under current South African law, mothers automatically receive full parental rights, while unmarried fathers must go through legal hurdles to gain equal legal standing. Even when a father is loving, responsible, and actively involved, courts often default to granting primary residence to the mother, leaving fathers with unequal access and undermining the principle of shared parenting.
This outdated approach does not reflect modern family dynamics and places unnecessary emotional and financial burdens on both parents. Most importantly, it deprives children of the essential bond with BOTH their mother and father. 👶❤️👨👩👦
Why Change Is Needed 📚🔍📊
Research from respected child development and psychology organizations, such as the Psychological Society of South Africa and UNICEF, shows that children who spend meaningful time with both parents grow up more emotionally stable, perform better in school, and develop healthier relationships. This evidence underscores the importance of shared parenting in creating a balanced and supportive upbringing for every child. Furthermore, the unequal treatment of parents under current law contradicts constitutional principles of equality, breaching both the rights of the parent and the child. Denying a child access to one loving and responsible parent without just cause deprives them of emotional stability, guidance, and financial support, while also placing an unfair burden on the other parent. Children do best when both parents are active and present in their lives. 🧠📖😊
What We Are Fighting For ✊👨👩👧👦💙
1.) Shared Primary Residence as the Default Starting Point – The law should presume that children benefit from equal time with both parents unless proven otherwise.
2.) Automatic Parental Rights for Both Parents – Unmarried fathers should, by default, be assumed to be present, involved, and responsible in the same way the law assumes for mothers, unless proven otherwise.
3.) Balanced Parental Responsibilities – Mothers should not be burdened with sole caregiving; shared parenting allows for a more equal and supportive family structure.
4.) Children’s Right to Both Parents – Laws should prioritize a child’s need for both parents rather than automatically favoring one as the primary caregiver.
5.) Fair Consideration in Custody Decisions – Fathers should not have to prove their worthiness to be involved; the starting point should be that both parents are equally important.
Why This Matters to Everyone 🌍👨👩👦💡
✅ For Fathers – It affirms their right to actively participate in their child’s life beyond just visitation.
✅ For Mothers – It reduces the overwhelming burden of single parenting and promotes fair co-parenting.
✅ For Children – It ensures they receive love, care, and guidance from both parents, leading to healthier development and emotional security.
✅ For Society – It fosters gender equality, fairness, and stronger family structures, benefiting future generations.
Take Action Now! 🖊️📢💪
We call on the National Assembly, the National Council of Provinces, the Department of Justice and Constitutional Development, and the South African Human Rights Commission to review and amend the Children’s Act of 2005 to ensure fair parental rights and responsibilities for all parents.
