The David and Goliath court battle sees the struggling Duggan family and its legal team matched against the unlimited resources of the US and Australian governments. Today the Duggans are simply trying to protect Dan’s rights by seeking an adjournment while applying legal aid. But even this simple request is being hotly contested by the bullying US prosecution and the unjust terms of Australia’s extradition treaty with the United States.
Dan has already been held in maximum security solitary confinement in NSW for more than 17 months - without any local charges or criminal history - as he awaits possible extradition to the United States. To make matters worse, our government’s agents have assisted the United States to confiscate Saffrine’s property, which has left her unable to properly mount Dan’s legal defence. As a result, they need legal aid to continue to represent Dan in court.
Dan’s family wrote to dozens of Members of Parliament in Canberra this week asking them to halt the ongoing attack on the rights of Australian citizens.
“The basic legal and human rights of my hard-working family have been forgotten in this case due to apathy, political bias and a complete lack of due diligence by the bureaucrats who advised the Government on this matter,” the letter said.
“My family has not been given the opportunity to have our voices properly heard or to defend the 12-year-old allegations that have been brought by a foreign power and defy common sense, or even the slightest scrutiny.
“At any time, Attorney-General Mark Dreyfus has the power to immediately release Dan and stop this inhumane torture of an Australian family.”
On February 14, Parliament overwhelmingly voted in favour of releasing Julian Assange from his incarceration in the UK and halting his extradition to the US, where he faces a potential sentence of 175 years.
“Please, don’t wait 13 years until trying to set Dan free - right this wrong that is happening right here in Australia now,” the letter said. “Unlike Julian’s case, this is in your power to stop.”
