Yesterday Magistrate Daniel Reiss denied this Australian citizen’s application to delay the extradition hearing even though his legal team, led by Bernard Collaery, clearly demonstrated that he needed more time to get Legal Aid after the United States blocked the sale of Saffrine’s property in December. The property was in the process of being sold to pay for legal bills.
The Magistrate even said Dan was an intelligent man who could defend himself if necessary, despite the complexity and severity of the disputed allegations that carry a potential sentence of 65 years in solitary confinement in a US Federal prison!
Bernard Collaery also made a dramatic revelation to the court – that the two substantive US allegations would not be successful because they did not apply to Australian citizens like Dan.
“This man is an Australian citizen and could not be and cannot be tried for two of the counts,” Mr Collaery said. “The US has no right to prosecute an Australian citizen for something that isn’t an offence in Australia.”
