Dear Mr. Winters,

We, the undersigned homeowners of Harpers Creek, respectfully submit this petition to propose the following amendments to our Homeowners' Association Covenants:

1.      Change the Structure of the Elected Board:

·        Current Structure: The Board consists of 3 elected members.

·        Proposed Structure: Increase the number of elected Board members to 5.

·        Reasoning: Expanding the Board will allow for a broader representation of our community's  perspectives and enhance the Board's ability to manage the responsibilities and needs of our community.

2.      Eliminate Mailed HOA Materials in Favor of Electronic Communications:

·        Current Practice: HOA materials are mailed to homeowners.

·        Proposed Change: Transition to all electronic communications for distributing HOA materials.

·        Reasoning: This change will significantly reduce costs associated with printing and mailing, and ensure timely delivery of important information to homeowners.

3.      Adjust Quorum Requirements for HOA Meetings:

·        Current Requirement: 25% of homeowners must be present at an HOA meeting to constitute a quorum.

·        Proposed Requirement: Maintain the 25% quorum requirement for HOA meetings.

·        Reasoning: This threshold is appropriate for ensuring adequate representation while being achievable for our community.

4.      Reduce Quorum Requirement for Amending CC&Rs:

·        Current Requirement: 67% of homeowners must approve amendments to the CC&Rs.

·        Proposed Requirement: Reduce the approval threshold to 40%.

·        Reasoning: With only 100 homes in our community, a lower threshold will facilitate necessary updates to the CC&Rs.

Signature Requirements:

·        Only one owner's signature per home is allowed.

·        Each signer must provide the address of the home they are signing for.

We believe these changes will benefit our community by improving governance, reducing unnecessary expenses, and making it easier to achieve quorum for important decisions. We kindly request that the Board consider these proposals and take the necessary steps to amend the Covenants accordingly.
