My husband Christopher P. Bell jr. is a disabled Naval veteran. He was incarcerated in 2005 on Robbery in Second degree. The PTSD my husband suffered due to service connection was never considered in mitigation. Now a law has passed that can bring former service men home where they belong Penal Code Section 1 1170.91(a) that allows evidence of service connected disabilities to be considered for releasing these Veterans. My husband has worked hard to overcome his disabilities in order to become a better husband, father,and productive member to our society. Help allow him this opportunity be that father to his children and help be a positive agent to his community. He put his life on the line for this Great Country of ours...Let us put our faith and belief in his recovery and ability to show us that growth and development in petitioning for his release. This petition is about a law change in California to take into consideration sexual trauma,post traumatic stess disorder, traumatic brain injury, substance abuse, mental health problems as a result of military service to have these things looked at as a mitigating factor. This could impact decisions in sentencing,if these things were known at the time. A hearing will be held to determine if the incarcerated person meets the criteria for relief. The Prosecution,Defense Attorneys, and victim of offense are notified. This takes place within 15 days of notice to Prosecution. The Court may in it's discretion resentence the person following a resentencing hearing. A person resentence pursuant this shall be given credit for time served. Under no circumstance may resentencing under this law result in more time than original sentence.
