Submit Ordinance 2025-22 (Concordia Development) to a Public Vote
The Issue
CITY OF INDEPENDENCE
PETITION TO SUBMIT ORDINANCE 2025-22 TO A PUBLIC VOTE
We, the undersigned registered electors of the City of Independence, hereby petition the City Council to submit Ordinance 2025-22 to a vote of the electors at the next general or regular municipal election. This petition is submitted pursuant to our rights under the City Charter.
WHEREAS, during the February 11 Council Meeting, Ordinance 2025-22 was discussed and adopted by a 5 Yes/2 No vote, paving the way for Petros Homes to develop detailed plans for a new neighborhood by rezoning city-owned land;
WHEREAS, significant public concerns have been raised regarding the rezoning process and the subsequent sale of city land for development;
WHEREAS, numerous public hearings, including a Public Hearing on February 4 and subsequent Planning Commission meetings, have been conducted regarding this matter, yet substantial citizen opposition remains;
AND WHEREAS, pursuant to the Charter, if the City Council fails to enact the proposed ordinance as submitted or passes it in a form different from that set forth in an appropriately signed petition, the petitioners, through the designated committee, may at the next regular Council meeting request in writing that the matter be submitted to a vote of the electors;
★ HIGHLIGHTED CHARTER PROVISION ★
"If the petitioners through the committee named on such petition request, by the next regular meeting of the Council, that the proposed ordinance or resolution be submitted to a vote of the electors, the Council shall provide for submitting the initiated ordinance or resolution to the electors at the next general or regular municipal election occurring more than ninety (90) days after the filing of such petition."
NOW, THEREFORE, we respectfully request that the City Council comply with the provisions of the Charter and:
Recognize this petition as sufficient under the applicable municipal procedures.
At the next regular Council meeting, formally request that Ordinance 2025-22 be submitted to a public vote.
Ensure that the matter appears on the ballot at the next general or regular municipal election scheduled more than ninety (90) days from the filing of this petition.
We trust that the Council will act in accordance with both the law and the will of the people of Independence.
